2023.06.02 16:27 equilarian SMART Terminal / AXIS Logistics Park Update

Hi All -- it's been a hot minute. I've been super busy but wanted to check in and post an update. This is the email that was just sent out:

We are on social media!! Please like, share, and follow us on Instagram and Facebook. We have been to posting content. If you have any photos or videos you'd like us to share, please send them our way.
We've also started posting yard signs around town. If you see one, be sure to scan the QR code and follow the links to email the entire city council.

Here are some upcoming dates. Please be sure to mark your calendars to join us!

SMTX City Council Meeting
SMART/AXIS Is not on the agenda, but we will be there to speak during public comment. We invite you to join us either virtually or in person. Council will be discussing if they want to change the rules to Council Committees, which was prompted by the way the SMART Council Committee was handled.

Community Town Hall 1
What does bringing a massive Heavy Industrial Park to San Marcos mean for our community and neighbors? Join us for a brief presentation and discussion / Q&A about where we've been, where we are, and what Heavy Industrial looks like for taxpayers, property owners, the river, Reedville, Maxwell, and Martindale. (posting a graphic in the comments)

Community Town Hall 2
2nd Community Town Hall with similar topic to 1st meeting. We will be going into more detail about what you can do to help at the July 3rd Council Meeting and signing up for Public Comment.

SMTX City Council Meeting - 1st reading of Heavy Industrial Zoning
City Council will be voting on the 1st reading of zoning the SMART / AXIS land to Heavy Industrial. We need AS MANY people as we can get to SHOW UP for our community and the river to speak during public comment. This is not a public hearing, so the only opportunity we have to speak is during Public Comment. Details on how to sign up will be provided once the timing is closer. (posting a graphic in the comments)

SMTX City Council Meeting - 2nd reading of Annexation and HI Zoning. BOTH PUBLIC HEARINGS
City Council will be voting on the 2nd reading of annexation and zoning the SMART / AXIS land to Heavy Industrial (if not delayed for whatever reason). Both readings are PUBLIC HEARINGS, so we each get a total of NINE MINUTES to speak like the April 18th meeting. The more people we can get to show up, the better. The more we can get to speak during public comment and both hearings, even better!
The April 18th meeting went for a little over FIVE HOURS. Let's make it last longer than that and truly show council how much we care and don't want this zoning to pass.

Other things.... We have given away all 100 of our signs! Thank you to everyone who has one in their yard. We are hoping to get some larger signs out into the wild. If you have a solid and visible location please let us know. Some of you have already reached out but a reminder is always appreciated. If there are more folks who want smaller signs we will need to make another order as well. Please reach out if you'd like a small sign.

We are seriously considering getting an attorney but need people to commit to join a board to represent the community. If you'd like to donate to hire an attorney, the retainer fee is $5000. Please reach out if you'd like to donate or are interested in learning more about what being on a board looks like. The purpose of an attorney is because the Development Agreement has a contingency clause in it that takes the city's voting power away through contract zoning. It states that if the land is not zoned HI, then the city cannot annex. However, annexation MUST happen

We Need Help Spreading the Word We printed out A TON of flyers and still have A TON left. If you'd like to pass out flyers please reach out.

At San Diego Comic-Con in July, Dwayne “The Rock” Johnson had other people raising eyebrows when he said that his long-awaited superhero debut in Spider Man Across the Spider Verse Movie would be the beginning of “a new era” for the DC Extended Universe naturally followed: What did he mean? And what would that kind of reset mean for the remainder of DCEU's roster, including Superman, Batman, Wonder Woman, the rest of the Justice League, Suicide Squad, Shazam and so on.As
Spider Man Across the Spider Verse Movie neared theaters, though, Johnson clarified that statement in a recent sit-down with Yahoo Entertainment (watch above).
“I feel like this is our opportunity now to expand the DC Universe and what we have in Spider Man Across the Spider Verse Movie, which I think is really cool just as a fan, is we introduce five new superheroes to the world,” Johnson tells us. Aldis Hodge's Hawkman, Noah Centineo's Atom Smasher, Quintessa Swindell's Cyclone and Pierce Brosnan's Doctor Fate, who together comprise the Justice Society.) “One anti-hero.” (That would be DJ's Spider Man Across the Spider Verse Movie.)
“And what an opportunity. The Justice Society pre-dated the Justice League. So opportunity, expand out the universe, in my mind… all these characters interact. That's why you see in Spider Man Across the Spider Verse Movie, we acknowledge everyone: Batman , Superman , Wonder Woman, Flash, we acknowledge everybody. There's also some Easter eggs in there, too.So that's what I meant by the resetting.Maybe 'resetting' wasn't a good term.only
one can claim to be the most powerful superhero .And Johnson, when gently pressed, says it's his indestructible, 5,000-year-old Kahndaqi warrior also known as Teth-Adam, that is the most powerful superhero in any universe, DC, Marvel or otherwise
. "By the way, it's not hyperbole because we made the movie."And we made him this powerful.
There's nothing so wrong with “Spider Man Across the Spider Verse Movie” that it should be avoided, but nothing—besides the appealing presence of Dwayne Johnson—that makes it worth rushing out to see. spectacles that have more or less taken over studio filmmaking, but it accumulates the genre's—and the business's—bad habits into a single two- hour-plus package, and only hints at the format's occasional pleasures. “Spider Man Across the Spider Verse Movie” feels like a place-filler for a movie that's remaining to be made, but, in its bare and shrugged-off sufficiency, it does one positive thing that, if nothing else, at least accounts for its success: for all the churning action and elaborately jerry-rigged plot, there's little to distract from the movie's pedestal-like display of Johnson, its real-life superhero.
It's no less numbing to find material meant for children retconned for adults—and, in the process, for most of the naïve delight to be leached out, and for any serious concerns to be shoehorned in and then waved away with dazzle and noise. Spider Man Across the Spider Verse Movie” offers a moral realm that draws no lines, a personal one of simplistic stakes, a political one that suggests any interpretation, an audiovisual one that rehashes long-familiar tropes and repackages overused devices for a commercial experiment that might as well wear its import as its title. When I was in Paris in 1983, Jerry Lewis—yes, they really did love him there—had a new movie in theaters. You're Crazy, Jerry."Spider Man Across the Spider Verse Movie " could be retitled 'You're a Superhero, Dwayne'—it's the marketing team's PowerPoint presentation extended to feature length.
In addition to being Johnson's DC Universe debut, “Spider Man Across the Spider Verse Movie” is also notable for marking the return of Henry Cavill's Superman. The cameo is likely to set up future showdowns between the two characters, but Hodge was completely unaware of it until he saw the film.
“They kept that all the way under wraps, and I didn't know until maybe a day or two before the premiere,” he recently said Spider Man Across the Spider Verse Movie Wakanda Forever (2022) FULLMOVIE ONLINE

2023.06.02 16:03 Apprehensive_Gur8188 Input/Advice Regarding "Portfolio" Sans Publications (PhD industry)

I’m looking for some input/advice regarding pivoting to an industry position and putting together a “portfolio” due to my lack of publications. So any and all feedback from those in industry is greatly appreciated. And if you read all of this, thank you.
Some background. I finished my PhD in plant science in 2015. I have two publications from that; both are first author. The first was an algal genome paper published in Science (2013). I did genome annotation for this project, but it was pretty vanilla/amateur and mostly brute force, e.g., running BLAST searches manually, etc. There was already a bioinformaticist (CS background) on the project that did most, if not all, of the “heavy lifting”. I also got into phylogenetics pretty heavily as a spin-off project (2nd publication), and had to basically teach myself Linux to run various programs at the time. Also became familiar with using clusters and such.
I’ve done 3 postdocs, albeit each were pretty short lived. The first was all bench work and lasted about 10 months. The position/lab was not a good fit, and it was destroying aspects of my personal life, i.e., relationships, etc. The next year I accepted the second postdoc because I desperately needed a job. This was a combination of dry/wet lab work (plant epitranscriptomics). Through this I got to dabble with chIP-seq and then started messing around with genome assembly and other NGS data (by my own volition). My contract was for 11 months and was not extended due to lack of funding. Fast forward to my third postdoc which started out all wet lab (plant synthetic biology) and then towards the end got to mess with RNAseq data for differential expression. I started the analysis for this, but eventually had someone from a neighboring lab specializing in RNAseq finish the analysis because they already had all of the pipelines basically drag and drop (I do have all of the scripts used to run the analysis from beginning to end). The third postdoc lasted 13 months, again due to lack of funding. The project I was initially brought in to take over had the funding revoked a few months after arriving to the lab. The biggest kicker, in my opinion, is that I have no publications from any of these postdocs.
Following my last postdoc I accepted a position with a hemp company as a geneticist. They had NGS sequencing data provided by Medicinal Genomics (Kannapedia) for quite a few of their strains. I started with raw sequencing data and pulled out all of the relevant sequences for cannabinoid biosynthesis and such. This didn’t really go much beyond that as I was laid off 6 months after getting hired; the company ran out of money and started laying off everyone...
For the past couple of years I’ve been working in intellectual property. I have no intention of attending law school, so I think I’ve pretty much reached my ceiling in this field.
So, I want to pursue a remote bioinformatics position in industry. I have a pretty strong wetlab background, which I think will help my cause as I can communicate very well with bench scientists. I understand the lingo and science/methodologies.
I watched all of Harvard’s CS50 (I did some, but definitely not all of the assignments), and I’m almost through Helsinki’s MOOC python course. I know I still have a lot to learn with Python, and I’ve barely touched R. I also have not messed with Next Flow or snakemake. I have a friend in industry and Nextflow is used heavily by their company.
My question is what should I do regarding putting together a “portfolio” that shows I’m competent sans publications? Should I attend a bootcamp? I could reach out to various research labs and offer to do free “on the side” work in exchange for my name on papers? Should I do yet another postdoc (don’t really want to) but focus strictly on “dry lab” work?
I do plan on using the hemp NGS data to do various analyses (not sure what just yet), and I can probably sneak that in my resume as real experience. I thought about even building a database to store all of the “cleaned” sequence data for simplified retrieval. Not that I need it, but just to show competency.
If you read all of this, thank you. Any and all feedback is appreciated. I consider my career thus far quite the dumpster fire, but I’m hoping to change that and settle into a somewhat new direction. I’ve also considered data science, but given my degree and experience, I think bioinformatics is a much more natural transition for the time being.

BATTLERS while not under a exclusive deal, are CONTRACTORS, until they are SALARY BASED of which they aren’t!
It’s like “you are an electrician, you do work here and there for a guy who owns a business that gets contracts for new structures, he pays you X amount overall or pays you Per day you work. When your task or duty is complete, and you pick up work with another guy, he calls you and says, hey you can’t do that job for the new guy, I don’t have a new contract yet and I know you filled your obligation for what I hired you for already, but I don’t fw them, so if you do that job YOU CANT COME BACK & I will make some calls to black ball you in the whole electrical world in our city I KNOW PEOPLE”
Like wtf, I SAY ALL THAT TO SAY, if battlers don’t build a UNION, and STAND AS ONE no matter PLATFORM, no matter STATUS, no matter WHO GETS PAID WHAT, no matter LEAGUE, and STRIKE, meaning all of them FULFILL THEIR CURRENT OBLIGATIONS, if they have a 3 battle deal, COMPLETE THEM, then DONT ACCEPT ANOTHER DEAL “none of them” and they all STAND ON THAT, get a lawyer that they all chip in to get, really it might be someone like a lawyer fan who may do it pro bono, because he loves battle rap & wants to see his dream matches that will never happen/ or because it will bring a lot of attention to his firm from something of this magnitude, write up a PLAN, a SET UP RULES, and DEMANDS that they all vote on and submit them to EVERY SINGLE LEAGUE OWNER, the leagues that can’t negotiate and make it work, ARE BLACK BALLED, and they all battle on other leagues FREELY as they please.. if none of the leagues agree, BUILD UP OTHER LEAGUES like THE RIOT/BULLPEN ETC and all the talent BATTLES IN THESE PLACES the leagues will get in line JUST LIKE THEY MAKE THE BATTLERS RN, because THERE IS NO LEAGUE without TALENT & even moreso WITHOUT BIG NAMES & even moreso WITHOUT FAN SUPPORT!!
Fans would have to BE APART OF THE MOVEMENT ALSO, but the battlers would have to be transparent to the public as to WHERE THINGS STAND and UPDATE THE PEOPLE so we could support by BOYCOTTING leagues that DONT FALL IN LINE, they can’t make money without SUPPORT from fans, they don’t have a league without TALENT, we will never get the battles we want WITHOUT FREEDOM, battlers will never be FREE without A UNION!!
Period

2023.06.02 15:10 Substantial-Slip-788 So who actually runs this "city" corporation?

Danielle West? Kate Snyder? Jess Grondin? all confused and suspicious as f. Jess has her fingers in everything, but the other two dont even seem to exist. I genuinely wonder if theyre alive.
Im just curious who's been pooling resources into bearcats theyll never use, for smiling black kid photo ops, and pavlovian conditioning with "candy in a cop vehicle" of sorts, and curious as to why one cannot identify any of the >120 officers by name or number when the info should be publically available.
Someone should keep an eye out on Jess honestly, and where she, or what her money does. She seems to always be the one talking when Portland sh*ts a brick, like the recent effort at discussing the food truck debacle in PPH paper, as if shes trying to justify it, like how somehow PPH did manage to last year even with wild % of people NOT in support of hamstringing local established businesses.
Thats kind of the goal though, in someones confusion: "get rich people here" = "more money for Portland". Its a classic attempt to believe in trickle-down economies, but its just a circle jerk of like 10 real-estate owning business majors who eat at each others high-end restaurants in buildings they own, while also being a major cause of Portlands bleeding of money, and hiding behind the liberal aesthetics of propping up a token foreign chef for the zeitgeists palate.
That or its one of those situations where we attract magazine-reading weirdos (rich bored people or dentists) with the "best place to live" bs year in and out that likely has a marketing cost associated with it at my tax expense.
So we get more and more insufferable flatlanders thinking they found their dream summer home/airbnb, or those same people, but who are also adult children, trying to understand a city, or society still, coming from God-knows-where Montana Bougie Ranch or some nonsense. Its so transparent that their privilege screeched away food trucks from the hill; theyre lost so far in their entitlement and detached living.
Im willing to bet one of them also writes that hideously out-of-touch new Munjoy magazine that is basically porn for them, or wine-mom types what with that "how to throw a dinner party" tome-deaf article (yeah- homeless crisis here- hello?). But sure, just keep being super coastal and un-melanated, like REALLY make it your identity eh?
NotHinG tO sEe HeRe Im jUsT kEePinG bEeS iN a CiTy WiThOuT tElLiNg My NeIGhBoRs! --Anyone in Portland now basically, just put a kombucha in their hands.
Anyway, I digress, and this city isnt liberal or democrat.
Im so sick of seeing forever-in-construction-condo rural workers and bougie elites and hill residents or construction CEOs taking all of portlands money, and moving it to the country, or a socially elite bubble that will invest it elsewhere (cops or landowners or construction oligopolies [cough cough Shaw Bros]) while SOMEONE is overspending on militarized police when you have homeless people dying on the streets in a wave that surpasses at least 40 years of relatively NOT HAVING THAT SH*T AND THE CULTURAL CONFUSION AND INFIGHTING IT CAUSES WHEN THE PROBPEM STARTS IN LOCAL POLITICIANS OR LACK THEREOF IN LIEU OF OLIGOPOLIES AND POLICE STATES.
Oh well, like in the colosseum of old, the landed gentry will watch and cheer as the riot geared up LARPers harass black people trying to protest, as opposed to say, escorting nazis around town to help them commit an assault and hate crime on city hall steps that they got away with because Maine is notoriously violent (being so rural at large, and never reporting anuthing, as police documentation is all but absent in this state historically and now, just ask Jess Grondin 😉) but youd never know since someone keeps paying for magazine awards.

2023.06.02 15:09 jcravens42 interview regarding situation for women in Afghnistan

a JURIST staff member — a legal scholar in Afghanistan, whose identity cannot be disclosed at present due to security risks — conducted the following interview with Dr. Hannah Neumann, a German member of the European Parliament (MEP) and an advocate for women’s rights, recently traveled to Afghanistan for the second consecutive year, gaining firsthand insights into the country’s devolution under Taliban rule. As a prominent figure in the European Parliament, her experiences on the ground and work within the legislative body shed light on the challenges faced by Afghan women and girls. To mark European Parliament Afghan Women Days, Dr. Hannah Neumann led a workshop called “Solidarity with Afghan women parliamentarians.
Based on your visits to Afghanistan, how do you perceive the evolving situation of women and girls in the country?
The Taliban’s victory in the war has led to their seizure of power – and their handling of this power, to put it mildly, is far from responsible. The consequences have been alarming, with UN experts expressing deep concern over the systematic crackdown on the rights of women and girls in Afghanistan. Since the Taliban’s press conference two days after the fall of Kabul, hardly any of their vague promises have become reality – be it regarding women being able to work and receive an education, or ensuring non-discrimination against women. Instead, what we are witnessing are alarming violations of women’s and girls’ rights, including restrictions on education, employment, and participation in public life that are unparalleled. An increasing number of decrees are designed to marginalize women from public life, confining them to the boundaries of the private sphere and limiting them to stereotypical domestic roles. This system can only be accurately described as gender apartheid.
Have you had the opportunity to engage in discussions with Taliban officials during your trips in both the current year and the previous year? If so, what have they told you?
During my visit this year in April, I did not meet up with Taliban officials. Nonetheless, during my talks with Taliban officials last year, I have come to understand that there are numerous contradictions in how they currently approach governance. While they express opposition to evacuations and express concerns about brain drain, they lack a vision for providing opportunities and livelihoods for women and minority groups in a future Afghanistan. Despite banning girls’ education, many Taliban members choose to home-school their own children. While asserting independence from international influences and emphasizing Afghan ownership, they at the same time complain about the decline in international funding for the national budget. It is also apparent that the Taliban may demonstrate proficiency as fighters, governing a country however requires a different set of skills. The transition from a violent insurgency to inclusive governance needs to occur swiftly, but currently, there is little to no visible plan in place. This is especially visible in cases where the population holds local Taliban accountable for things that do not work well under their responsibility. They simply lack a proper response – or even willingness to engage in such conversations. Compared to the situation last year, things are slowly progressing in some regions where individual Taliban on the ground have realised that they need to participate in exchanges and dialogues. Yet all of this is far from any form of sustainable or inclusive governance.
As a Member of the European Parliament, how will you continue to push for and highlight the need to protect women’s rights in Afghanistan?
Afghanistan under Taliban rule is a ticking time bomb, and the international community cannot afford to turn a blind eye, even if finding solutions is far from easy. In the European Parliament, we have consistently placed Afghanistan on our agenda since the Taliban takeover, including our recent resolution addressing the crackdown on education activists, which I actively supported. Additionally, I am heavily involved in ongoing discussions with colleagues from other EU institutions to leverage the collective strength of the European Union and develop a comprehensive approach. One of my key priorities is to provide a platform for Afghan women, both from within the country and in the diaspora, with the goal of making sure that their opinions, goals and concerns reach a wider audience and inform policy making in the key international fora. During my most recent trip to Afghanistan, I had the opportunity to talk to numerous women who shared their experiences and challenges, highlighting the importance of supporting women-led initiatives and projects. I am committed to fighting for more and flexible funding to support these organizations and ensure they have the resources they need to carry out their vital work.
Women in Afghanistan are bravely fighting for their rights, and some civil society activists are proposing aid suspension as a means to exert pressure on the Taliban. What is your stance on the matter?
Humanitarian aid is delivered based on internationally recognized principles, namely humanity, neutrality, impartiality, and independence. These principles are crucial for its effective functioning. Given the growing and drastic poverty in Afghanistan, it is our responsibility to provide humanitarian assistance in accordance with these principles. It is important to emphasize that this assistance is directed towards the people of Afghanistan, to whom we are committed, and not to the Taliban. The UN estimates that 28 million individuals will require assistance in 2023 alone. Even a slight reduction in aid would be fatal, as it would result in numerous deaths; disproportionately affecting women and girls. The recent decrees by the Taliban stopping women from working in international NGOs aim to politicize humanitarian assistance. We need to clearly oppose any such attempts, but where we can continue to work in line with the humanitarian principles, we should do so. According to reports from most humanitarian organisations, they can continue to work in most regions of the country, also because certain sectors, such as healthcare, are being exempt from the Taliban’s restrictions. The approach needs to be: For women, by women – and wherever this is possible, aid delivery directly to the people should continue.
The response from the international feminist movement to this deplorable situation has been relatively muted. Why do you believe this is the case, and what actions can the feminist movement take to support Afghan women and girls?
Since the Taliban takeover, many feminist organizations, diaspora organizations, activists and politicians have continuously been denouncing the gender apartheid system imposed in Afghanistan. Nevertheless, in the last two years various crises have emerged, such as the war in Ukraine, the protests and their violent crack down in Iran, the global hunger crisis, or most recently the Sudan crisis. Frequently, the international focus has shifted to address these urgent issues, making it difficult to sustain attention on Afghanistan. The geographical distance, as well as the challenges faced by the Afghan people in speaking out against political injustice and raise global awareness, have contributed to this change. Additionally, there seems to be a growing fatalistic mindset that suggests there are no further actions we can take to support Afghan women. I strongly disagree with this notion. It is crucial that we redouble our efforts and stand in solidarity with Afghanistan, for as long as it takes. During my recent trip, I had a meaningful exchange with an Afghan women activist who articulated the role that the international feminist movement should play: „We want you to amplify the voices of Afghan women, to convey our message where we are unable to, and to support us in our domestic struggle for our rights.“ While we must continue to denounce the oppressive actions of the Taliban and their infringement on women’s and girls’ rights, we should also champion the empowerment of Afghan women by addressing their specific challenges and providing them with the necessary support and opportunities. Concrete actions include providing a platform and support for women who continue to work under Taliban rule, advocating for easier funding access and removing financial barriers for women-led organisations and projects. Additionally, facilitating visa access for women, particularly those in the business field, would enable them to make their voices heard internationally, for example by participating in trade fairs. As one woman put it: „Afghanistan is very black these days – but there is also some pink and it is our duty to make sure it stays.“

Do you have concerns about how Mortgage Originators and Secondary Market Issuers determine a mortgage's collateral value? How they can use automated valuation models (AVMs) to manipulate & overestimate property value, rife with conflict of interest opportunities creating securitization risk? COMMENT
Six federal regulatory agencies request PUBLIC COMMENT on a proposed rule designed to ensure the credibility and integrity of models used in real estate valuations. In particular, the proposed rule would implement quality control standards for automated valuation models (AVMs)
https://www.federalreserve.gov/newsevents/pressreleases/files/bcreg20230601a1.pdf
Under the proposed rule, the agencies would require institutions that engage in covered transactions to adopt policies, practices, procedures, and control systems to ensure that AVMs adhere to quality control standards designed to ensure the credibility and integrity of valuations. The proposed standards are designed to ensure a high level of confidence in the estimates produced by AVMs; help protect against the manipulation of data; seek to avoid conflicts of interest; require random sample testing and reviews; and promote compliance with applicable nondiscrimination laws.
AVMs are used as part of the real estate valuation process, driven in part by advances in database and modeling technology and the availability of larger property datasets. While advances in AVM technology and data availability have the potential to contribute to lower costs and reduce loan cycle times, it is important that institutions using AVMs take appropriate steps to ensure the credibility and integrity of their valuations. It is also important that the AVMs institutions use adhere to quality control standards designed to comply with applicable nondiscrimination laws.

The Proposed Rule

  • The agencies are inviting comment on a proposed rule to implement quality control standards for the use of AVMs that are covered by this proposal.
  • The agencies’ proposed rule would require that mortgage originators and secondary market issuers adopt policies, practices, procedures, and control systems to ensure that AVMs used in certain credit decisions or covered securitization determinations adhere to quality control standards designed to meet specific quality control factors.
  • The proposed rule would not set specific requirements for how institutions are to structure these policies, practices, procedures, and control systems. This approach would provide institutions the flexibility to set quality controls for AVMs as appropriate based on the size of the institution and the risk and complexity of transactions for which they will use AVMs covered by this proposed rule. As modeling technology continues to evolve, this flexible approach would allow institutions to refine their policies, practices, procedures, and control systems as appropriate.
  • The agencies’ existing guidance related to AVMs would remain applicable.
  • The quality control standards in section 1125 of title XI apply to AVMs “used by mortgage originators and secondary market issuers to determine the collateral worth of a mortgage secured by a consumer’s principal dwelling.”
  • The proposed rule would implement the statute by applying the quality control standards when an AVM is being used to make a determination of collateral value, as opposed to other uses such as monitoring value over time or validating an already completed valuation. Determinations of collateral value are generally made in connection with credit decisions or covered securitization determinations as defined in this proposed rulemaking, for example when determining a new value before originating a purchase-money mortgage or placing a loan in a securitization pool. Other uses of AVMs, such as for portfolio monitoring, do not involve making a determination of collateral value, and thus are not within the scope of the proposed rule.
  • The agencies are further proposing that the rule would not cover the use of AVMs in the development of an appraisal by a certified or licensed appraiser, nor in the review of the quality of already completed determinations of collateral value (completed determinations).
  • The proposed rule would cover the use of AVMs in preparing evaluations required for certain real estate transactions that are exempt from the appraisal requirements under the appraisal regulations issued by the OCC, Board, FDIC, and NCUA, such as transactions that have a value below the exemption thresholds in the appraisal regulations.
  • Section 1125(c)(1) provides that compliance with regulations issued under this subsection shall be enforced by, "with respect to a financial institution, or subsidiary owned and controlled by a financial institution and regulated by a Federal financial institution regulatory agency, the Federal financial institution regulatory agency that acts as the primary Federal supervisor of such financial institution or subsidiary.”
  • Section 1125(c)(1) applies to a subsidiary of a financial institution only if the subsidiary is (1) owned and controlled by a financial institution, and (2) regulated by a Federal financial institution regulatory agency. Section 1125(c)(2) provides that compliance with regulations issued under this subsection shall be enforced by, "with respect to other participants in the market for appraisals of 1-to-4 unit single family residential real estate, the Federal Trade Commission, the Bureau of Consumer Financial Protection, and a State attorney general.”
  • The proposed rule would define “covered securitization determination” to mean a determination regarding (1) whether to waive an appraisal requirement for a mortgage origination in connection with its potential sale or transfer to a secondary market issuer, or (2) structuring, preparing disclosures for, or marketing initial offerings of mortgage-backed securitizations. Monitoring collateral value in mortgage-backed securitizations after they have already been issued would not be covered securitization determinations.

Rules on AVMs used in connection with making credit decisions:

The proposed rule would apply to AVMs used in connection with making a credit decision. The proposed rule would define “credit decision,” in part, to include a decision regarding whether and under what terms to originate, modify, terminate, or make other changes to a mortgage. The scope provision of the proposed regulatory text would expressly exclude the use of AVMs in monitoring the quality or performance of mortgages or mortgage-backed securities. The use of AVMs solely to monitor a creditor’s mortgage portfolio would not be a credit decision under the proposed rule because the lending institution has already made the credit decision. The scope of the proposed rule would include, for example, decisions regarding originating a mortgage, modifying the terms of an existing loan, or renewing, increasing, or terminating a line of credit. The proposed rule uses the term “credit decision” to help clarify that the proposed rule would cover these various types of decisions. The proposal to limit the scope of the rule to credit decisions and covered securitization determinations reflects the statutory definition of AVM, which focuses on the use of an AVM “by mortgage originators and secondary market issuers to determine the collateral worth of a mortgage secured by a consumer’s principal dwelling.”23 The proposed rule would distinguish between using AVMs to determine the value of collateral securing a mortgage and using AVMs to monitor, verify, or validate a previous determination of value (e.g., the proposed rule would not cover a computerized tax assessment used to verify the valuation made during the origination process).24 The proposed rule focuses on those aspects of mortgage and securitization transactions where the value of collateral is typically determined. Loan modifications and other changes to existing loans. The proposed rule would cover the use of AVMs in deciding whether to change the terms of an existing mortgage even if the change does not result in a new mortgage origination, as long as a “mortgage originator” or “secondary market issuer,” or servicers that work on the originator’s or secondary market issuer’s behalf, uses the AVM to determine the value of a mortgage secured by a consumer’s principal dwelling. For example, the proposed rule would cover AVMs used in making decisions to deny a loan modification or to confirm collateral values, such as when there is a request to change or release collateral. In relevant part, section 1125 provides that an AVM is “any computerized model used by mortgage originators and secondary market issuers to determine the collateral worth of a mortgage . . . .”25 The agencies’ view is that the phrase “determine the collateral worth” broadly covers instances where mortgage originators and secondary market issuers use AVMs in connection with making credit decisions. Under the proposal, the agencies consider mortgage originators and secondary market issuers or servicers that work on their behalf to be using AVMs in connection with making a credit decision when they use AVMs to modify or to change the terms of existing loans.

How I understand it:

  • The rule would cover a range of decisions such as mortgage origination, modification, or termination, and uses "credit decision" as a blanket term to simplify this. Think of it as the umbrella under which all these different decisions take shelter.
  • The rule would differentiate between using AVMs for deciding the value of collateral securing a mortgage and using them to check, validate, or affirm a previous value determination. In short, it’s not about looking back and second-guessing, but rather about making fresh valuation decisions.

AVMs used by secondary market issuers:

The language of section 1125 includes not only mortgage originators, but also secondary market issuers. Given that the statute refers to secondary market issuers and the primary business of secondary market issuers is to securitize mortgage loans and to sell those mortgagebacked securities to investors, the proposed rule would cover AVMs used in securitization determinations. In addition, covering AVMs used in securitizations could potentially protect the safety and soundness of institutions and protect consumers and investors by reducing the risk that secondary market issuers will misvalue homes. For example, misvaluation by secondary market issuers could in turn incentivize mortgage originators to originate misvalued loans when making lending decisions Such misvaluations could pose a risk of insufficient collateral for financial institutions and secondary market participants and could limit consumers’ refinancing and selling opportunities.

How I understand it:

  • The proposed rule would also apply to AVMs used in securitization decisions, because secondary market issuers are typically busy bundling up these mortgages for selling to investors.
  • By extending to securitizations, the rule could help protect the safety of institutions, consumers, and investors by reducing the risk of misvaluing homes. So, it's like a security guard keeping watch over the valuation process.
    • Misvaluation by secondary market issuers could encourage mortgage originators to originate misvalued loans, a domino effect we don't want to see in the lending decisions....
      • Such misvaluations could pose a risk of insufficient collateral for financial institutions and secondary market participants and could limit consumers’ refinancing and selling opportunities.

Appraisal waivers:

The proposed rule would define “covered securitization determination” to include determinations regarding, among other things, whether to waive an appraisal requirement for a mortgage origination (appraisal waiver decisions).Under the proposal, a secondary market issuer that uses AVMs in connection with making appraisal waiver decisions would be required to have policies, practices, procedures, and control systems in place to ensure that the AVM supporting those appraisal waiver decisions adheres to the rule’s quality control standards. In contrast, a mortgage originator that requests an appraisal waiver decision from a secondary market issuer would not need to ensure that the AVM used to support the waiver meets the rule’s quality control standards because the secondary market issuer would be using the AVM to make the appraisal waiver decision in this context, not the mortgage originator. For example, both GSEs have appraisal waiver programs and are the predominant issuers of appraisal waivers in the current mortgage market. To determine whether a loan qualifies for an appraisal waiver under either GSE program, a mortgage originator submits the loan casefile to the GSE’s automated underwriting system with an estimated value of the property (for a refinance transaction) or the contract price (for a purchase transaction). The GSE then processes that information through its internal model, which may include use of an AVM, to determine the acceptability of the estimated value or the contract price for the property. If the GSE’s analysis determines, among other eligibility parameters, that the estimated value or contract price meets its risk thresholds, the GSE offers the lender an appraisal waiver. In this example, when the GSEs use AVMs to determine whether the mortgage originator’s estimated collateral value or the contract price meets acceptable thresholds for issuing an appraisal waiver offer, the GSEs would be making a “covered securitization determination” under the proposed rule. As a result, the proposed rule would require the GSEs, as secondary market issuers, to maintain policies, practices, procedures, and control systems designed to ensure that their use of such AVMs adheres to the rule’s quality control standards. On the other hand, when a mortgage originator submits a loan to determine whether a GSE will offer an appraisal waiver, the mortgage originator would not be making a “covered securitization determination” under the proposed rule because the GSE would be using its AVM to make the appraisal waiver decision in this context. As a result, the mortgage originator would not be responsible for ensuring that the GSEs’ AVMs comply with the proposed rule’s quality control standards.

How I understand it:

  • Defining "Covered Securitization Determination": This term would include decisions about waiving an appraisal requirement for a mortgage origination, also known as appraisal waiver decisions.
  • If these issuers use AVMs for making appraisal waiver decisions, they need to have policies and control systems in place to ensure that the AVMs adhere to the rule's quality control standards.
  • Mortgage originators requesting an appraisal waiver from a secondary market issuer wouldn't have to ensure that the AVM used meets the rule’s quality control standards.
    • This responsibility would rest with the secondary market issuer, not the originator.
  • GSEs as an Example: When GSEs (like Fannie Mae and Freddie Mac) use AVMs to decide whether the mortgage originator’s estimated collateral value or the contract price meets thresholds for issuing an appraisal waiver, they would be making a "covered securitization determination". As such, GSEs would need to ensure AVM adherence to the rule's quality control standards.
    • When a mortgage originator submits a loan to see if a GSE will offer an appraisal waiver, the originator is not making a "covered securitization determination", so they don't need to ensure GSEs' AVMs comply with the proposed rule’s quality control standards.

Other uses by secondary market issuers:

The proposed rule would define “covered securitization determination” to include determinations regarding, among other things, structuring, preparing disclosures for, or marketing initial offerings of mortgage-backed securitizations. Monitoring collateral value in mortgage-backed securitizations after the securities have already been issued would not be a covered securitization determination. The proposed rule would cover AVM usage if and when a secondary market issuer uses an AVM as part of a new or revised value determination in connection with covered securitization determinations. For example, the GSEs use the origination appraised value or the estimated value in appraisal waivers when issuing mortgage-backed securities. Hence, AVMs are not used by the GSEs to make a new or revised value determination in connection with MBS issuances. However, because the GSEs provide guarantees of timely payment of principal and interest on loans that are included in an MBS, they are obligated to purchase loans that are in default from MBS loan pools. The GSEs may modify such loans and subsequently re-securitize them as new MBS offerings. In these instances, the GSEs may use an AVM to estimate collateral value for investor transparency and disclosure. AVMs used in this manner by the GSEs would be considered covered securitization determinations because there are new or revised value determinations. As discussed in part II.A.3 of this SUPPLEMENTARY INFORMATION, the proposed rule distinguishes between secondary market issuers using AVMs to determine the value of collateral securing a mortgage versus using AVMs solely to review completed value determinations. For example, AVMs used solely to review appraisals obtained during mortgage origination would not be covered by the proposed rule.

How I understand it:

  • “Covered Securitization Determination”: This term would include decisions about structuring, preparing disclosures for, or marketing initial offerings of mortgage-backed securities.
    • However, monitoring collateral value after securities issuance wouldn't fall under this definition.
  • The rule would apply if a secondary market issuer uses an AVM for new or revised value determination in relation to covered securitization determinations.
  • Although GSEs don't use AVMs for new or revised value determinations for MBS issuances, they do use them when re-securitizing defaulted and modified loans for new MBS offerings.
    • In these cases, AVMs are used for estimating collateral value for investor transparency, and these instances would be considered covered securitization determinations.
  • The proposed rule differentiates between using AVMs to determine collateral value and using them only for reviewing completed value determinations.
    • For instance, using AVMs solely to review appraisals obtained during mortgage origination wouldn't be covered by this rule.

AVM uses not covered by the proposed rule

Uses of AVMs by appraisers. The proposed rule would not cover use of an AVM by a certified or licensed appraiser in developing an appraisal. This approach reflects the fact that, while appraisers may use AVMs in preparing appraisals, they must achieve credible results in preparing an appraisal under the Uniform Standards of Professional Appraisal Practice (USPAP) and its interpreting opinions.33 As such, an appraiser must make a valuation conclusion that is supportable independently and does not rely on an AVM to determine the value of the underlying collateral. The agencies also note that it may be impractical for mortgage originators and secondary market issuers to adopt policies, procedures, practices, and control systems to ensure quality controls for AVMs used by the numerous independent appraisers with which they work.
Who watches the watchmen though?

TLDRS:

  • The proposal discusses the use of automated valuation models (AVMs) by mortgage originators and secondary market issuers to determine a mortgage's collateral value
  • Institutions engaged in certain credit decisions or securitization determinations would be required to adopt policies and procedures to ensure AVMs used adhere to quality control standards.
  • The proposal also aims to protect against data manipulation, avoid conflicts of interest, require random sample testing and reviews.
    • Data Manipulation: By implementing quality control standards and promoting transparency, this rule may reduce the risk of AVMs being manipulated to overestimate or underestimate a property's value.
    • Conflicts of Interest: It may mitigate potential conflicts of interest where a party could benefit from the property's valuation being higher or lower than its actual worth.
    • Inaccurate Valuations: The required random sample testing and reviews could catch systematic errors or biases in the AVMs that lead to inaccurate property valuations.
    • Discrimination: By requiring compliance with nondiscrimination laws, the rule could address loopholes where certain properties might be undervalued due to location in certain neighborhoods or other discriminatory practices.
    • Securitization Risks: The rule could help reduce the risk of mispriced mortgage-backed securities, by ensuring that the underlying assets (i.e., the properties) are properly valued. This is particularly crucial because undervaluation or overvaluation of properties could result in financial instability.
  • How does this relate to GameStop?
    • The broader economy is seeing regional banks blow up at these rates, what sort of stress will higher rates cause in the banking system with those trying to maintain their short positions for another day if they can't tip the scale on valuations on items that have become linchpins of their collateral down the line?

2023.06.02 13:26 cyrusposting Attempting to rule out the Government Experiment Theory (How old is Fromville?)

There is a tempting theory that Fromville is a government experiment. I would like to rule out this theory as best as I can, so we can move on to other theories. The most compelling evidence for the Government Experiment theory, in my opinion, is that all of the residents have been taken from somewhere in the continental United States. Let's talk about that.
Map of locations people arrived in the town from, showing no entry points from outside the continental US.
There's someone from San Diego, but nobody from Mexico, 17 miles away. There are pins tantalizingly close to the Canadian border too, but nobody was actually grabbed from Canada. Nobody from the Caribbean either, and nobody from Alaska or Hawaii.

Does it matter? Could it just be the writers catering to an US audience?

I think this map is intentional evidence of something. If they can have two characters (Kenny's Parents) who speak very little English, I don't think having a Mexican or a Canadian marked on a map would make Americans less likely to watch the show. Remember, these characters wouldn't even have to be still living or appear in the show. The pins on the map don't all correspond to still living characters, and it is an intentional choice to simply stop at the border.

How many people are counted here?

One thing worth mentioning is that these are only people who came after some undefined point, but I think given that this map is in the Sherriff's office we can assume they started keeping track after Boyd's arrival 2 years ago.
I can't quite make out most of the names, and my screenshot doesn't help, but I can't find any names from Colony House. Let me know if you can. It might help for someone who is better than me at reading handwritten text to open this in the actual show where you can get the best resolution. The questions to answer here are whether its only people from the town, and who is the longest staying resident we can find.

Why just the US?

Here are all of the theories I have for why this would only be happening to Americans.
  1. Fromville is an experiment being carried out by the US Government.
  2. The entrance to Fromville, being a wormhole or whatever else, has to be transported physically, by land, and it would be problematic to get it through customs.
  3. Fromville is designed to punish Americans for something. This would have to be a punishment for something that Canadians and Mexicans didn't also do, which rules out settling the Americas.
  4. Every country gets their own.
  5. Its some mystical, paranormal force that for some reason cares about modern political borders. Maybe its the ghost of Osama Bin Laden or something.
  6. Something cultural or logical prevents them from making it onto this map. If its only people who settled in the town that make it onto the map, maybe it was impossible to convince Spanish speakers to get inside. The problem with this is that Canada is not culturally different enough from the United States to create a filter here. Maybe Canadians are all lumberjacks and when they hit the tree in the road they just cut it up and haul it out. Who knows. I can't think of how this theory would work, but its still possible.
  7. Its coincidence. Canada and Mexico have a lower populations than the United States, and if you squint the pins seem to have some correlation with regional population density. Maybe they just got lucky.
  8. It has to do with the interstate system. All of these pins seem to be placed on interstates. Mexico and Canada do not have an interstate system the same way the US does. I heard somewhere that one motivation for building the interstates was the Cold War, as an efficient way to evacuate cities in case of a nuclear attack. Maybe there's something there.
  9. Its a simulation so anything can happen, who cares.
  10. The people running Fromville don't want to introduce a language barrier. This theory is also weak, considering Kenny's parents speak very little English, and people were taken from south Florida, south Texas, and San Diego, who could very easily have been Spanish speakers. America in general is not a monolingual country. On the other hand, if people are selected individually (which the bus with Krysti's fiancée implies) then Kenny's family could have been selected *because* they have Kenny to translate, and the people from heavily Spanish speaking parts of the United states could be collected at no risk of introducing a language barrier to isolate them.
  11. It could be because of something I haven't thought of, let me know in the comments.
I don't like most of these answers, but they're what I've got.

Why just the continental US?

  1. The US Government is running the experiment, but lacks the resources to do anything in Alaska or Hawaii despite having wormhole technology. Or they just don't care to run this experiment on Hawaiians and Alaskans, because they wouldn't get useful data from them for some reason.
  2. The entrance to Fromville, being a wormhole or whatever else, has to be transported physically, by land, and it would be problematic to get it through customs.
  3. Hawaii and Puerto Rico don't have long enough stretches of empty country roads, while Alaska just doesn't have enough people for it to be likely that one is here, the same reason why there's nobody from Wyoming, Idaho, or Nebraska.
  4. The wormhole operates within some radius, you can draw a circle on a map which includes all of these pins but excludes Hawaii and Alaska.
  5. It could be something I haven't thought of, let me know in the comments.
Again, none of these are great answers, but its all I've got.

Dating the beginning of Fromville.

If Fromville is 5 years old, the government experiment theory is plausible. The older Fromville is, the less likely it is that the US Government had the potential to create this kind of thing. Even setting aside the impossible geometry, we have seen wires that go nowhere but still power things. We've seen bioengineered superhumans who can shapeshift and rip a person apart in seconds, all while being impervious to bullets. Not to mention the ability to induce shared hallucinations and read minds.
Not only are these things beyond present technology, they are things a government would find extremely useful for projects that make a lot more money than torturing two dozen of its own citizens secretly. I think, without some kind of magic, we can rule out almost all human causes. Terror attacks, government experiments, basically every explanation of a manmade Fromville, except The Matrix or something supernatural, like magic. All we need to do is prove that Fromville is very old.
So, maybe the present-day government has this technology and is keeping it a secret, or its still being tested. In that case, did they have this technology in the 70's, when Victor arrived? As we go further back, it becomes less plausible.
We see Civil War uniforms on some of Jade's hallucinations, which would be dated to the 1880s, but these civil war soldiers may not necessarily have been trapped in Fromville or may not have actually existed at all.
What about the US Marine that Boyd meets in the tower? He doesn't recognize Boyd's style of pistol, presumably because its a semi automatic. The first semi automatic sidearm formally adopted by the US military was the Colt 1911, adopted in 1911. If you've seen a Colt 1911, you wouldn't look at Boyd's pistol and say "That doesn't look like any pistol I've seen.'(Or whatever his exact wording was.)
That marine was probably a civil war soldier or earlier, who would only have been familiar with revolvers. I doubt the technology we see in the show is older than the semi automatic pistol.
If we wanted to date Fromville older than this, we can get into things I can't prove.

A picture of the talismans.
When I first watched the show, my first thought was that these symbols were Rongorongo because of the human shapes. Then, I started thinking about writing systems that would more plausibly have been in North America at some time. Looking more into it, these look like they could be Icelandic staves. I am neither Icelandic nor am I an anthropologist, but I feel like there isn't enough discussion on who would have carved these so I'll try to at least say enough to get a discussion going.
Icelanders used to carve symbols into a form of stone called lignite. Lignite is a soft stone which, from google image searches, often has this same blueish-gray color. If these are Icelandic staves, they probably date back to around 1000 AD, the approximate possible date when Icelandic people settled Newfoundland. The middle of the talisman looks like the rune ᛝ and the dashes along the outside look like ᚫ, but with an extra notch. The only examples I was able to find with three notches were on this runic calendar dated around the 12th or 13th century AD found in Finland.
\"Sami Runic Calendar\" showing a character resembling ᚫ but with an extra notch. Look in the bottom right if you don't see it.
I have no idea what the significance of the extra notch is, or if its something that was only done on calendars. If the talismans are calendars, obviously the circular shape is significant. This could also be an older form of the rune, or any number of other possibilities because languages and writing systems are hard, constantly evolving, and I am not an anthropologist. Also, there are only so many shapes you can make when carving notches into a rock and the talismans don't necessarily have to be Icelandic just because they look like some runes.
One counterargument to all of this is that this same symbol appears on the cave writings by the monsters.
Victor showing the cave drawings.
My theory, assuming the talismans are Icelandic, is that the domain of Fromville either used to extend to Newfoundland 1000 years ago, or that some Vinlanders(which is what I will call Icelandic settlers in Newfoundland, I don't know if this is a real word) were blown off course and found their way into its domain. Obviously, if Fromland is over 1000 years old, sticking to the modern day boundaries of the continental United States would be extremely strange. It would also be extremely strange that there is evidence of Vinlanders but 0 evidence of any First Nations people despite Fromville being 1000 years old.
Regardless, these Vinlanders found themselves trapped, much like our modern day protagonists. They desperately designed staves that they hoped could ward off the creatures, and eventually someone managed to make one that worked. These staves were then passed down or dug up by more and more generations of Fromlanders, until eventually Boyd found them. Meanwhile, the monsters, either by somehow assimilating humans or through their observation of the talismans, came to draw these symbols themselves.
My theory on why the stave worked is that it could say some equivalent of "I'm not afraid of you", the same thing Darrel says to the creatures surrounding the bus.
The stick with three notches could also be depicting trees or waves, and not be a rune at all. On the cave drawing, surrounding the boats and spaced randomly, they look like waves. On the talisman, evenly spaced in a ring around the human figures, they look like trees
Regardless, if any of this holds up, a healthy majority of historians believe that the United States Federal Government was not functional or existent in 1000AD. At the very least, their technology was extremely limited.

2023.06.02 13:09 rusticgorilla Supreme Court ruling makes it even riskier for unions to strike

Housekeeping:
Eight Supreme Court justices issued a ruling yesterday that will allow companies to more easily sue unions for damages during a strike.

Background

The case, Glacier Northwest v. Teamsters, centers on a cement truck driver strike in Washington state. Glacier alleges that Teamsters Local Union No. 174 intentionally ordered a work stoppage after the trucks had been loaded with wet concrete, potentially wasting the product and risking damaging the rotating drums of the trucks.
According to Glacier, the goal was to “sabotage” the company:
In August 2017, the Union, which represents Glacier’s truck drivers, was engaged in collective bargaining negotiations with Glacier. Unhappy with the company’s response to its bargaining demands, the Union devised and executed a scheme to “intentionally sabotage” Glacier’s business operations and destroy its property. On the morning of August 11, Glacier had numerous concrete deliveries scheduled, with drivers starting work between 2 AM and 7 AM. Knowing this, the Union “coordinated with truck drivers to purposely time [a] strike when concrete was being batched and delivered” with the specific purpose “to cause destruction of the concrete.” At 7 AM, once “Union representatives knew there was a substantial volume of batched concrete in Glaciers barrels, hoppers, and ready-mix trucks, they called for a work stoppage.” A Union agent made a throat-slashing gesture to signal a “sudden cessation of work.”
Non-union employees were dispatched to clean the trucks, preventing damage. However, the mixed concrete had to be destroyed.
The Teamsters contended that the strike could only be called once all drivers had arrived for work. With staggered start times, this resulted in a 7 am strike time, after some concrete loads were already mixed and in trucks from earlier shifts.
On the day the strike began, 43 drivers were scheduled to work. The drivers arrived at staggered start times running from 2 a.m. to 7 a.m. Local 174 called the strike at 7 a.m., when all of the scheduled drivers had arrived for work…When the strike began, some trucks were at Glacier’s yard waiting to be loaded, some were returning to the yard to be reflled and some were out with loads of concrete to be delivered. Sixteen of the striking drivers returned trucks containing undelivered concrete to Glacier’s yard. These drivers left their trucks running so that Glacier could dispose of the concrete as the Company saw fit.
Glacier sued the Teamsters in Washington state court for intentionally destroying its property. In doing so, the company indirectly challenged existing Supreme Court precedent set in 1959’s
San Diego Building Trades Council v. Garmon, which held that the National Labor Relations Board (NLRB) has jurisdiction over whether a labor union’s activity is protected by law.
It is not for us to decide whether the National Labor Relations Board would have, or should have, decided these questions in the same manner. When an activity is arguably subject to § 7 [which includes strikes] or § 8 [unfair labor practice] of the Act, the States as well as the federal courts must defer to the exclusive competence of the National Labor Relations Board if the danger of state interference with national policy is to be averted…If the Board decides, subject to appropriate federal judicial review, that conduct is protected by § 7, or prohibited by § 8, then the matter is at an end, and the States are ousted of all jurisdiction. Or, the Board may decide that an activity is neither protected nor prohibited, and thereby raise the question whether such activity may be regulated by the States.
Glacier should have brought its complaint to the NLRB, which would have decided whether this particular strike violated the law. Instead, Glacier brought the case to the Washington state courts, lost, and ultimately appealed to the U.S. Supreme Court.

The ruling

Justice Amy Coney Barrett, writing for the eight-justice majority, ruled against the Teamsters union in finding that an employer may pursue a lawsuit against its workers’ union before the NLRB determines whether a particular strike is protected by federal law.
Barrett reaches this conclusion by determining that the truck drivers’ failure to strike before the mixing of concrete violated the National Labor Relations Act’s (NLRA) “reasonable precautions” clause — a strike is not a protected activity if workers fail to take reasonable precautions to avoid foreseeable, imminent damage to the employer's property, such as the building, equipment or products.
The Board has long taken the position—which both the Union and Glacier accept—that the NLRA does not shield strikers who fail to take “reasonable precautions” to protect their employer’s property from foreseeable, aggravated, and imminent danger due to the sudden cessation of work. Given this undisputed limitation on the right to strike, we proceed to consider whether the Union has demonstrated that the statute arguably protects the drivers’ conduct. Davis, 476 U. S., at 395. We conclude that it has not. The drivers engaged in a sudden cessation of work that put Glacier’s property in foreseeable and imminent danger…The Union failed to “take reasonable precautions to protect” against this foreseeable and imminent danger.
With this ruling, the Supreme Court partly reverses Garmon. Employers will now be allowed to sue unions in state court before the NLRB completes its review of the case. As Ian Millhiser explains in Vox, the outcome (1) is costly for unions and (2) creates a more uncertain atmosphere for strikes:
Glacier Northwest is still a significant loss for unions, in large part because it does not draw clear lines indicating when Garmon still applies and when it does not. Suppose, for example, that a single angry worker picks up a piece of their employer’s equipment and smashes it at the beginning of a work stoppage. Does this one worker’s wildcat action render the entire union vulnerable to litigation?
Similarly, imagine a company much like Glacier Northwest, except that this company is so busy that it always has at least one truck full of wet concrete being delivered to a client. At what point are this union’s workers allowed to strike? And, if they do strike, what are the precise precautions the union must take in order to protect the employer’s trucks?
Questions like these will need to be decided in future litigation — and the mere existence of this litigation will only undermine Garmon even more. Striking unions will now potentially have to litigate one case in the NLRB while simultaneously litigating a second case whose purpose is to determine whether their employer is allowed to sue them in state court.
That will make it much easier for well-moneyed employers to grind down unions with legal fees.
Justices Roberts, Sotomayor, Kagan, and Kavanaugh joined Barrett’s opinion. Justices Thomas, Gorsuch, and Alito concurred in judgment, but wrote or joined separate opinions advocating for the Supreme Court to overturn Garmon altogether. Justice Thomas wrote:
The parties here have not asked us to reconsider Garmon, nor is it necessary to do so to resolve this case. Nonetheless, in an appropriate case, we should carefully reexamine whether the law supports Garmon’s “unusual” preemption regime. In doing so, I would bear in mind that any proper pre-emption inquiry must focus on the NLRA’s text and ask whether federal law and state law “are in logical contradiction,” such that it is impossible to comply with both.

The dissent

Justice Ketanji Brown Jackson, the lone dissenting justice, wrote in defense of Supreme Court precedent, the National Labor Relations Act, and the right to strike:
The right to strike is fundamental to American labor law. Congress enshrined that right in the National Labor Relations Act (NLRA) and simultaneously established the National Labor Relations Board to adjudicate disputes that arise between workers and management. That decision reflected Congress’s judgment that an agency with specialized expertise should develop and enforce national labor law in a uniform manner, through case-by-case adjudication. For its part, this Court has scrupulously guarded the Board’s authority for more than half a century. See San Diego Building Trades Council v. Garmon, 359 U. S. 236 (1959). Under Garmon, and as relevant here, a court presented with a tort suit based on strike conduct generally must pause proceedings and permit the Board to determine in the first instance whether the union’s conduct is lawful if the conduct at issue is even “arguably” protected by the NLRA.
Today, the Court falters. As the majority acknowledges, the Board’s General Counsel has filed a complaint with the Board after a thorough factual investigation, and that complaint alleges that the NLRA protects the strike conduct at the center of this state-court tort suit. The logical implication of a General Counsel complaint under Garmon is that the union’s conduct is at least arguably protected by the NLRA. Consequently, where (as here) there is a General Counsel complaint pending before the Board, courts—including this Court—should suspend their examination. Garmon makes clear that we have no business delving into this particular labor dispute at this time.
But instead of modestly standing down, the majority eagerly inserts itself into this conflict, proceeding to opine on the propriety of the union’s strike activity based on the facts alleged in the employer’s state-court complaint. As part of this mistaken expedition, the majority tries its own hand at applying the Board’s decisions to a relatively novel scenario that poses difficult line-drawing questions—fact-sensitive issues that Congress plainly intended for the Board to address after an investigation.
The court incorrectly placed the onus of protecting Glacier’s property on the workers and the union, Jackson continued:
To the extent that the majority’s conclusion rests on the alleged fact that “by reporting for duty and pretending as if they would deliver the concrete, the drivers prompted the creation of the perishable product” that “put Glacier’s trucks in harm’s way,” I see nothing aggravated or even untoward about that conduct. Glacier is a concrete delivery company whose drivers are responsible for delivering wet concrete, so it is unremarkable that the drivers struck at a time when there was concrete in the trucks. While selling perishable products may be risky business, the perishable nature of Glacier’s concrete did not impose some obligation on the drivers to strike in the middle of the night or before the next day’s jobs had started. To the contrary, it was entirely lawful for the drivers to start their workday per usual, and for the Union to time the strike to put “maximum pressure on the employer at minimum economic cost to the union.”
Nor was the onus of protecting Glacier’s economic interests if a strike was called in the middle of the day on the drivers—it was, instead, on Glacier, which could have taken any number of prophylactic, mitigating measures. What Glacier seeks to do here is to shift the duty of protecting an employer’s property from damage or loss incident to a strike onto the striking workers, beyond what the Board has already permitted via the reasonable-precautions principle. In my view, doing that places a significant burden on the employees’ exercise of their statutory right to strike, unjustifiably undermining Congress’s intent. Workers are not indentured servants, bound to continue laboring until anyplanned work stoppage would be as painless as possible for their master. They are employees whose collective and peaceful decision to withhold their labor is protected by the NLRA even if economic injury results.

Chapter 88 - From All I Believed

Morning, Two days before Shel
Captain Setar suppressed a smile as she watched the Ops door close. “Well, that was interesting…Ce’lani is a little cranky.” The last vestiges of sleep clung to her as she settled down into the command chair. She felt worn out, but it was the cusp of dawn, and Pod Seven had only just turned over control. “Report on station?”
“The perimeter’s secure,” Jelki replied crisply, pulling up the map of the campus on the main screen. “Pod One is on station and reports twelve by twelve. Sgt Ma’reis is already complaining about janitor duty.”
“Ah, first pod problems.” Setar shook her head, rubbing her eyes and blowing gently on her mug of tea. “What about the objective?”
“The objective’s secure,” Re’lan piped up, already sounding chipper. The woman could have been priestess of Jrafell. Her unwavering cheeriness would have been a character fault if she weren’t so devoted. As it was, it was a damned penance for everyone else at this time of day.
Jelke finished running the obligatory shift change checks and stretched. Things wouldn't get interesting until breakfast, but watching the perimeter was a given. It didn't keep the curiosity out of her voice, as she cocked her head and glanced over. “What was interesting with Captain Ton’is, Ma’am?”
“Mm! Well… it appears she’s expecting a call from Professor Warrick today,” Setar drawled out, taking a moment to savor their reaction. “She felt a need to remind me she’s devoted to Hele, and that if Be’ona or I let her sleep through the call, she’s going to ‘fuck us up the ass with a lasrifle and pull the trigger’.”
Re’lan was probably blushing like a cadet, but Jelke shook her head ruefully. “I expect there's a ‘but’ in there somewhere, Captain?”
“Well, yeah, she said that’s where the rifle would go…” Setar sniggered before taking a long sip from her tea, and slid a bit lower in the command couch. Her eyes wandered to the traffic on the board. “She also made it clear what’ll happen if anybody listens in.”
Thoughtful silence descended. Setar almost counted to twelve before-
“We’re going to anyway, right Captain?” Jelke asked nonchalantly. “You know, for security’s sake?”
“Sergeant, that would be a base infringement of Captain Ton’is’ privacy, which is in fucking short supply for everyone in this bunker.” She rubbed her chin thoughtfully, watching the steam rise from her mug. “Deeps right we are.”
_ _ _
Lady Wicama regarded her guest with interest as their autocab plied its way about the outskirts of Prelitauri. While she’d been free and cheerfully able to accommodate Khelira’s request, Monsignor Santino Barcio, or Friar Barcio, as he preferred, was not at all what she’d been expecting. She supposed it was a matter of exposure…
The Palace had never quite been the same since Princess Yn’dara’s wedding. Yn’dara was one of those odd Royals who, though well-regarded, was seldom in the public eye. A perennial favorite of the Empress, indulging her unexplained absences passed as a matter of course for the Court. Widely known to be estranged from her mother, Princess Arduina, no one enquired either deeply or often, so when she suddenly resurfaced, her return would have equally passed without comment… if not for the wedding.
Yn’dara had shocked the entire Nobility.
While it was common for any woman to marry into an established family and become a kho, the wedding should have been singular for a Princess. Princesses didn’t marry into families, Princesses formed them. And while Yn’dara technically had done so, she’d taken on four unmarried women at the same time as her husband, who was a Human! Favorite or no, the wags in the court were agog that the Empress accepted Adam so readily! The Empress, however, had been adamant; Yn’dara and her family had her blessings, and were to be left alone.
However, time had proven to be on Yn’dara’s side as well as the Empress.
After a wedding seen across the galaxy, Yn’dara’s family settled into a life of public duty. They spent long trips away from Shil, and while quietly dismissed as ‘pleasure excursions’, her trips often showed the throne to the outer provinces. Although her public engagements were few, she’d become a vocal advocate of the Empress’ reforms against graft and corruption, and, gradually, the jealous mutters about scandalous excess and Human debauchery faded away. Her marriage remained an unusual footnote, but time had demonstrated the value of Yn’dara and her wives to the throne.
Then there was Prince Adam.
Rumor held the Prince had made a favorable impression on the Empress years before, at an event hosted by Yn’dara’s mother. While details had never been forthcoming, a more significant story about Adam wafted briefly through the ranks of the Golden Glaives.
Both stories had been effectively silenced, but Wicama knew who to talk to, and being Khelira’s guardian carried a certain clout all its own. Though that influence waxed and waned over the years, raising Khelira required being aware of events that could shape her future, and she’d proven herself to be discreet. Over time, doors had opened and words had flowed.
Time had been on Prince Adam’s side, as well.
As the years passed, she’d had an exposure to Prince Adam that few of the court and none of the public enjoyed. She’d been wary at first, but he’d been a good friend and mentor to Princess Khelandri before she joined the Marines, and however infrequent his presence, he always displayed a keen mind, a loving heart, and a steadfast duty to his wives. Privately, he absolutely doted on young Khelira and possessed a loyalty to the Empress that you could bend battlesteel around. The two got along famously - after all, he was a veteran.
Not Navy, mind you, but you couldn’t have everything.
And so, as Humanity began making forays upon the galactic stage, her first impression of the species had been favorable. She’d witnessed Adam mature into his role with the court, and while the issue of children remained unspoken, that faded as well. At the time, Yn’dara had been sixth in the line of succession. A year after the wedding, Kamaud’re became an adult, followed a year later by Khelandri, and the matter became largely moot.
As for a second impression on Humans, Khelira had provided enthusiastic reports about Thomas Warrick. While the Princess thrived at the Academy, Warrick seemed to be something special.
The absence of a father in her life had been a void that no woman could properly fill, but she’d done her best. Although she’d entertained a few qualms, as the months passed by, Warrick remained a positive influence. Khelira’s messages were infrequent by necessity, but she’d written about her distress over Warrick’s family and clearly been moved. Prince Adam carried his own scars, but what veteran didn’t? He hid them carefully around Khelli, and if Warrick had chosen not to, he’d provided a useful sense of perspective, instead. It was time for Khelira to grow up, and that meant facing the grist of differing opinions and ugly realities. That was what education was actually for, and Warrick seemed to be doing admirably well as a grindstone.
All of that was before the library incident, which settled her opinion once and for all. While erratic, irreverent, and capable of violence, Humans clearly could be a positive influence when channeled in the right direction. Yn’dara had shown what a good Shil’vati woman was capable of with Prince Adam, and Lady Pel’avon was following suit.
And at least the wags at the Palace wouldn’t speak of Yn’dara’s state wedding again. As a subject for spectacle, Miv’eire Pel’avon’s had put it to shame.
Still, it was good to see Warrick married. While Professor Ha’meres scandalous exploits had faded from the public eye, older wo… more mature women didn’t forget such things. The man had been a daring adventurer - and an inveterate gadabout - and an unmarried man around that many young women was too tempting for some girls. A wife or two… preferably more… resolved such idle fancies. If the Pel’avon ceremony had been somewhat… questionable in taste, compared to Adam’s, it remained legally binding. Warrick was willing to settle down, and by all reports his wife had a proper sense of decorum.
Human men seemed to be a trial from the Goddess, but hopefully she and her kho-wife could sort him with time, love, and kindness.
While exposure to only two Humans was not what she’d call a comprehensive sample, in both cases her impressions had been quite positive. And so, when Khelli asked her to escort a Human Priest about the city, she’d been entirely willing.
Thus far, it had been an enjoyable morning. While there had been occasional missteps, their conversation had been delightful as they traveled from property to property. Even so, she hadn’t expected to meet such a kindred spirit.
Admittedly she’d stammered a bit when he mentioned eating the flesh and drinking the blood of his redeemer. On the other hand, she compared it to the first time she’d bled into the ocean, mingling salt in her blood with the seas. He’d turned shockingly pale, so she changed the subject. It was a purely symbolic act to Drepna - just a cut on the thumb, for goddess sake...
She’d taken extra care afterwards. Barcio could be clearly a sensitive male, but diplomacy was part of her work. Even calling her role ‘work’ was deceptive. She’d raised Khelira in every way an Empress could not.
It was easy for other women to appreciate the prestige of her position, but few understood the depth of it - or the satisfaction.
During her career in the Navy, her flotilla had provided direct support for the Empress, and they’d come to work closely over three tours. After Khelira’s birth years later, the invitation came from the Royal Household to act as her guardian, and she’d never looked back. Competition had been fierce for the prestigious position, but applying had been the best move of her life.
Empress Kamilesh loved all her children and had spent as much time with each of them as she could, but her work was all-consuming, and after her husband’s act of… Well, the Empress had been there, but she’d born her pain privately. She had lost herself in her work for many years before recovering a semblance of her former self, and her absence had taken a toll on her children. Kamaud’re had taken it the worst. Khelandri had bounced back, while everyone doted on Lu’ral. Barely more than an infant, Khelira had been far too young to remember. Wicama had been there through all of it.
It was a good life, and the princess was a delightful girl. For Wicama, the absence of a man in her life was something she’d felt now and then, but she invested her life in Khelira. The Empress treated her as a member of the family in all but name… and in a very real sense, the child you raised was your child.
Looking back, some women might insinuate she’d given up her personal life to raise another woman’s daughter. They couldn’t have been more wrong.
She had her calling - just as Friar Barcio had his.
Yes, he was a priest, and his religious strictures were very unusual. A male priest in any of the Shil’vati faiths would never be placed under such restraints, and for a man to go unmarried was noteworthy…
But she understood having a calling. Oh yes, she understood that as few others could.
After discussing his needs, they’d set out to examine three properties around Prelitauri. The Friar’s individual requirements were deceptively difficult when taken as a whole. A complex coupling a generous auditorium, ample administrative space, and he clearly needed substantial grounds to properly convey a sense of aura. Such accommodations were seldom on the market, and since he expected his colleagues to arrive in weeks, his need was immediate.
Thankfully, urban renewal moved in waves. The tides of such fashions meant Prelitauri was once again an up-and-coming area. While difficult to find, three older structures had the potential to be suitable, and so it was that she’d enjoyed learning about her guest as they explored the tiny district.
The Monsignor spoke four other Earth languages fluently. He tended to break into his native tongue and hadn’t mastered contractions yet, but his Vatikre was passable and he listened carefully, seldom needing to ask about a word. After limiting her contractions when she spoke, their conversation flowed easily.
Barcio had shown little enthusiasm for the first two properties, but their conversation regarding other matters never waned. She expanded on her devotion to Drepna, Shil and the roles of each goddess while asking careful questions of his faith. His own inquiries proved thoughtful, and he was as avid in politely asking after her beliefs as explaining his faith.
After their second hour together, she’d taken the liberty of calling Prelate Hi’meta Merlamiss. As a priestess of Drepna’s second circle, Merlamiss had proven a valuable contact over the years. Well connected, she enjoyed a good relationship with many other prelates of the Divine Halls; she also got on well with Xinfess, the Rakiri’s Speaker of the Dark Mother on Shil. A meeting with Barcio would readily open doors for his group that might otherwise prove difficult to attain, and while Barcio’s accent strained now and then, it was clear the Monsignor and the Prelate shared a questionably low sense of humor.
Given a chance, they’d probably get on famously.
Certainly, that would be a blessing. Their hunt for a suitable facility had not gone nearly so well, and while Barcio had been conciliatory toward the first two facilities, she could tell he wasn’t taken with either. The last property wasn’t high in her expectations, so she found herself casting her head to the side when it swept into view and he clasped his hands in excitement.
”*È bella!* This is beautiful,” he exclaimed. “It reminds me a bit of my childhood home in Sacile!”
She looked out at the complex with its low gabled roofs, as their cab wound up from the entrance. Beside the drive, a small river meandered through the campus past the main buildings. She tapped the console to slow their ride and considered the place in a new light. “I’m… well, a bit surprised to be honest, Friar.”
“Please! We have been traveling for hours now, and I am not holding a service.” The Friar spared her a warm smile, before gazing back at the premises. “I would take it as a great kindness if you would call me Santino.”
“Very well - on the condition you call me Wicama.” It had been some time since anyone called her by anything but title or rank, and the informality was pleasant. Still, as their autocab closed on the end of the lane, she let such thoughts go and considered the location properly.
The buildings were low, sensible cubes, but that was largely an end to it. The architect had made some unusual choices in Helkam motifs that strained understanding. A long colonnade bordered the river, and that seemed nice enough, but the buildings! Forgoing purple was one thing, but they were beige! With unusual elements and the repressively bland color scheme, it was small wonder the clerk handling the property confessed that the space had lain vacant. Its original owners went into foreclosure. The exotic design had proven unable to attract interest, laying dormant ever since.
Barcio… Santino… seemed delighted, however, and she pulled up the specifications on her omni-pad. “This site has two smaller auditoriums besides the main one, while the central building has four floors. One is underground, but all the floors face an interior atrium.”
As the cab gently halted in the car park, she climbed out to hold the door but Santino had already scrambled out and was examining the gardens with evident interest. Tall stands of parago trees were losing the last of their fronds for the year, but she had to admit the grounds were substantial. Yesterday’s storm had left the morning air cold and crisp, lending the gardens an appealing aspect. Untended since the last owners, much could be done with them.
She had given up trying to escort the Friar anywhere after their first two stops, and now they fell into an easy pace side by side as they strolled toward the main building. She turned back to the property itself. “So, this reminds you of your home?”
It wasn’t exactly Helkam architecture - domes weren’t covering every possible surface - but the builder had clearly been nodding in that direction. A promenade wound to the entry, supporting white chevrons that arced into the sky. The bright morning sky shone through clever cutouts, making the unusual design at least look light, rather than oppressive and unappealing. With a decent renovation, the facility had possibilities, and the price was comparatively low.
“*Si!* Oh, not so much like home, but there is the sense of it. I was born near the sea, and this feels… similar.” He gave her a depreciating smile before rolling his eyes. “It may not please everyone who is coming, but ‘everyone’ is not here, so I am allowed some indulgence! Better to have something waiting than nothing at all. I confess, some of my colleagues thought we’d only manage when the bridge to Messina is finished.”
“You should not have been sent ahead alone! Surely your colleagues were not that worried about a poor reception,” she tutted. Priest or no, there were decencies about a man traveling alone to be observed. “You shouldn't need a bridge to find a place for your mission. I don’t know where Messina is, but I’m certain Prelate Marlemis wouldn’t stand for it!”
“Tch! Excuse my poor efforts! The older I get, the more I remember things like yesterday. Unfortunately, the yesterdays I remember so well were thirty years ago!” Barcio smiled wryly up at her as they walked. “The ‘bridge to Messina’ used to be a saying… People dreamed of building a bridge to Sicily, and it became something that never happened. My English friends would instead say ‘when hell freezes over’. *Un'espressione volgare*, but very much to the point.”
“Ah… I’m sure we can manage something, and this could be made presentable. Maybe change the beige to a pale violet?” she offered helpfully as she made it to the door first, holding it open. “The aura inside isn’t so bad.”
“You’ve said that several times, but I do not know what you mean?” He paused in looking around the entry, which had an open foyer exposing the two floors above and led out to the atrium beyond. “What is ‘aura’? I do not think I know the word as you mean it.”
“Aura is… Hmm…” Wicama paused thoughtfully and gestured at the atrium. The interior was in better shape than the grounds, and the architect had done something clever. Not yet noon, a bevel along the top edge filled the space with sunlight. “Have you ever walked along a beach and wanted to save a shell? When you are there, that is aura… When you take the shell home and think of the beach, that is aura, but… less focused. Diminished. You sense the beach because of the shell, but you are not at the beach. Places can have aura, but it is more than character. If you move through a place and find yourself experiencing it? That is aura.”
“Mhm! *lodevole!*“I like this idea very much. It would be right at home in the Vatican. Not everyone understands a space can move the spirit, or lend power to a message.” He nodded thoughtfully as he cast his eye about the open space. “With the right advice, perhaps we can lead others to these halls.”
“Perhaps. If you tour the Palace, I hope you’ll allow me to show you about? A lot of the real gems are hidden from the public.” She watched as he wandered toward the double-helixed stairways bordering the room. Those were definitely Helkam; walking up one side without meeting someone coming down the other was an interesting experience… once. After that, they could be an absolute nuisance. Spotting the elevators, she called him back. “The nice thing is this place is inexpensive! That will pad out your funds for a good remodel.”
Wicama quietly thanked the Goddesses that the builder’s had the good sense to install normal Shil’vati-style elevators. The sides were open, granting a wide view out over the atrium. The grounds were terraced to create a small park; that could make the underground space bearable, and the plans made them seem spacious enough. Not to everyone’s taste, but pretty. “I feel bad for asking, but can you afford the building? If the price of the first two bothered you, we can find others.”
“I would not hear of it! Thank you for your concern, but we are economical with our funds, and were sent with a generous sum. This is an important venture to everyone involved,” Barcio clasped a hand over his chest, as he shook his head. “I can not thank you enough for your help! You have surely spared me weeks, and I might not have found something half so suitable. As it is, the grounds are enough to gain me converts. Father Roscio and Pastor Weber will surely plant a vineyard before the inside is half done!”
“It’s not a problem. I have plenty of time,” she replied, dismissing the matter as inconsequential. “I work at the Palace, but with the Court away and my daughter at school, I’m a bit at loose ends just now. At the very least, I insist on helping you through the paperwork. I wouldn’t put it past some realty clerks to try and overcharge you… Someone from outside Shil, that is. I’ll ensure they stick to the listing.”
“To someone not from Shil… or someone who is not Shil’vati, perhaps?” His head canted slightly to one side, but he smiled as he said it. “*Certamente!* I would not dream of preventing you, though Rabbi Kleinbaum will be bitterly disappointed she has nothing to moan about.”
“I hope you won't take this badly, as I’ve only met one Human.” Wicama gave him a smile. She was long past girlish uncertainty, and the Navy had taught her a generous measure of professional poise to go with her skills as a markswoman. “You aren’t what I expected.”
“You know the professore, then?” He sucked in a breath and pursed his lips. “I am still deciding what sort of man he is.”
“No, actually, I know another Human but I’ve not… I have not… met Professor Warrick.”
“So. You mean that I am not *un barbaro*? I am here to make sure that we are seen as something more than savage warriors, *capisci*?” He studied her expectantly. “While the Imperium is doing good work on Earth, some still live in want. The Imperium provides enough for all to survive, but not all live in plenty. We need to present ourselves well.”
”That seems like a very secular outlook.” She offered, as they rode up to the third floor. Barcio asked for an explanation of the word, and by the time they’d made their way through the first offices he had the idea.
“My church has not always troubled itself with such things, but our holy father is greatly concerned with such inequalities. He takes it upon himself to address such matters with the Governess, when their time allows.”
“Your church has a good relationship with her?”
“È straordinario! The Governess adores our food, and while she was adamant about taking quarters in the Vatican, she has taken pains not to disturb us.” He shrugged dismissively. “*Cosa sai fare?* It seemed a small price, and we have endured far worse.”
“I used to hear terrible stories about red zones on Earth, though the Humans I’ve met don't seem the sort. It is good that your… pulp?” She tried the word and was rewarded with kind laughter and a gentle correction. “It is good that your pope concerns himself with the full welfare of the people and works with your governess. Our prelates share the same concerns.”
“I thought the Empress was the head of your church? Now, I find you have many…” he groped for a word, frowning, and gave up. “*Questo accento è una prova di fede!* ‘Denominations’ is not the right word, but she is the one revered, yes?”
“Of course! The Empress has to show all of our virtues and none of our faults, but that’s part of her role. To favor any divinity over the others could cause divisions. She has her personal preferences, of course, but never lets them be known.” Wicama explained carefully. “It would be in poor taste.”
“And poor politics, I think?” Santino gave her a long look. At his height it was difficult, but he managed. “This makes sense to me now, that the Imperium leaves matters of faith alone. *Una benedizione inaspettata.*”
Despite the serious topic, his fervent reply brought a smile back to her lips. “It seems your pope considers politics as well as economics.”
“People will always defend economic theories which assume that growth will inevitably succeed in bringing about greater justice. This has never been confirmed by the facts, and expresses a crude trust in the goodness of those wielding economic power and the sacralized workings of the prevailing economic system.” He said, stopping to clasp a hand over his cross. “Meanwhile, the excluded are still waiting.”
“That doesn't sound like scripture.” She offered cautiously, as they made their way into a wider suite of offices on the second floor.
“*Esattamente* The words of Pope Francis, a good and blessed man who appointed me to my position. His successor, his holiness John Paul the Third, is much of the same mind.” Santino said quietly. “Our savior washed the feet of others and urged all to do the same. The hardest step is to be involved. To work together for change, as well as to pray. That is why I am here.
“*I pigri di cuore trovano sempre una scusa* Some Humans, they are yet angry with the Imperium. Now they have enough, they are bitter not to have plenty. For some there is never enough - the true poverty lies within their hearts,” Santino said a bit testily. “Our faith teaches us to find salvation in eternal life, but others? *Pigrizia!* They see it as an excuse from taking agency in themselves. Jesus washed the feet of others - he did not lay down and wait for someone to wash his!”
Wicama turned the unfamiliar metaphor over in her mind but decided she had the sense of it. “Sham teaches us that helping our families and one another is the same as helping ourselves. ‘The rising tide bares us all from the reefs’.” It was a matter of faith… but that was why it was faith in the first place. On the whole, it seemed like a mature perspective that explained the changes she’d seen in Prince Adam over the years. “You’re here to meet with others, but this seems as much about knowing yourselves.”
“*Sì, non è una brutta cosa avere umiltà davanti a Dio.* Human beings, while we are capable of the worst, we are also capable of choosing the good. Of rising up to make a new start. We are entering the galaxy.” He gestured out the window at the world beyond. “If not now… when?”
_ _ _ “So, when are you going to explain this masterpiece you four have been cooking up?” Marin asked. Sammi and Sam were barely awake but the twins had already arrived, bright-eyed and enthusiastic, and Marin cursed the resilience of youth. The room was acceptably warm, but Ayen had complained about the cold and used the excuse to slip back into bed. She was considering her options for joining him.
Somewhere, somehow, Sammi had found their rabbit pajamas again. “Sam, explain it to her? You do it better.” Sammi yawned, but Marin suspected it was an act. Once something got their attention, sleep was usually an afterthought.
“What, now?” Sam had barely stumbled into the room and blinked. Bleary-eyed and barely awake, he looked like he’d been ambushed, which was exactly the case.
“Pllllllleeeease…?” They sat back pulling the ears, giving their best Roger Rabbit impression. Luminous green eyes peered out at Sam, imploringly.
“Alright… I need coffee, but fine.” Sam trudged over to the kitchenette and poked listlessly at the instant coffee. It was getting perilously low, but Marin was sure he’d brought more on the ship. Eventually Sam gestured at the K’herbhal sisters with his mug. “So the girls want to create an artificial topological soliton. It's like a black hole, except where it isn't… It's sort of a kink in space-time.”
“Made you say kink!” Sammi grinned impishly and the girls blushed. Marin shook her head but paid attention. It felt far too early after another late night, but once everyone was up you had to hang on for whatever came next.
“So, what's that got to do with this… hole you want to use for power?” Marin raised her voice just enough to drag the conversation back on track.
“It’s more like a side effect. If it cuts the right angle, it goes into a realm of space-time we can tap for power. Think of it as an obverse of an energy drain, so it's like a white hole.”
“Let me guess.” Marin shook her head and grinned, holding up a hand to forestall the inevitable. “Except where it isn’t?”
“Ummm… pretty much.” Sam grumbled, blowing at his coffee. Marin glanced back at the twins. With Sam busy, the twins had gravitated to either side of Sammi. There was room left on the couch, and she wandered over to settle in beside one of them.
The Sams had been complaining for years about a lack of ‘focal power’ for their mass compression technologies, and while a rubber duck inside a diamond was impressive, they’d wanted to do something more - a lot more. She suspected if the twins were providing the means, then they already had something about to surface from the depths of their imaginations. Over the years she’d learned to pick a bit, rather than take their answers at straight value. “And if things don’t cut at the right angle? You remember how long it took to get rid of the Navy, when you started talking about making black holes?”
“It's not our fault they didn’t understand,” Sammi said defensively, crossing their arms and pouting at her before the rabbit ears fell over their face.
“Who didn’t understand what?” Akeimei yawned at the door. She cast a wink her way before wrapping her arms around Sam and gave him a quick hug. “What did I miss?”
“Umm… a parallel universe, if the math is right,” Sam mumbled from the depths of his coffee cup.
“What? Like identical versions of us?” Marin watched Akimei’s nose wrinkled at the smell before she slipped away from Sam. Slipped down beside her, they rubbed shoulders a moment. “Tell me, is there one where I get more sleep?”
“More or less identical… though it's not like you need to go into a parallel universe for that sort of thing. There’s already a ‘you’ out there somewhere right now, to say nothing of past and future ‘you’.” Sam scratched his cheek idly for a moment “It's just the math. The universe is so vast that there are exact physical cosmic twins of us out there somewhere, not to mention even more almost-twins.”
“Sam’s right!” Sammi perked up excitedly, bouncing on the sofa. “Then there are quantum cosmic twins - which gets weird because particles exist in multiple states and you’d sort of overlap… but the easiest one is probably just another us elsewhere in the universe right now! That's sort of the point where things are since the universe is bigger than you can imagine!”
“So exactly the same… or almost.” One of the twins giggled. “Just like us!”
“Pretty much,” Sam nodded, slowly emerging from the depths of his coffee. “Another you out there on another Shil, or another me on a whole Earth, even - just a little bit different.”
“What? Like an Earth that never met the Imperium?” Marin canted her head, tossing out the obvious. It was hard to remember her life before, and she didn’t want to contemplate the alternative.
“Oh, I don't like that idea.” One of the twins stuck out her lip. “We want to come to Earth!”
“Yeah,” her sister nodded, though she suddenly looked glum. “I don’t know if Professor Warrick would mind though. He’d be with his wife and daughter, there.”
“Oh…” her sister's face crumpled. “I didn’t think of it that way.”
“Well, don’t…” Sammi hugged them both a moment, though they held the first twin a bit tighter. “The point is, somewhere he’s with them right now!”
“Wow, I guess so.” she brightened. “Just imagine! A whole Earth that never met the Shil’vati!”
“I wouldn’t worry, sis.” her twin nodded. “I think Professor Warrick is pretty happy right now.”

“I am not happy about this!” Tom glared at his omni-pad before tossing it down in frustration.
Miv looked up at her husband.
“It’s an honor!” She tucked her chin in and gave him a long, considered look, “What is it that’s bothering you - really? It wasn't Monsignor Barcio. Are you certain this isn't the same sort of thing?”
“Yes, I’m sure!” he growled, looking away like a guilty child. “Alright, maybe… but this uniform is the silliest thing I’ve ever seen. I’ll look like a mushroom, and the hat only makes it worse!" Tom grimaced at the omni-pad accusingly, "They won’t take ‘no’ for an answer, so now I’m on the rolls as a Warden Captain - whatever that is - and this ceremony is ridiculous!”
“The ceremony is traditional. Very symbolic... Besides, they don't make wardens out of anyone below the rank of captain - I looked it up. You were one before, so it's appropriate to make you one instead of a Warden Major or Warden Colonel.” She smiled at him serenely. “Surely, it can’t be the worst thing you’ve ever done.”
He turned to wag a finger her way. “I’ll take that bet!”
“Worse than our wedding reception…?” She crooned, teasing him. “Or maybe pre-term night? I swear by the Goddess no one will pinch your ass, except for Lea and I.”
“Fine… “ Her smile grew wider as he grumbled, but he was calming down already and there wasn't heat in it. Still, he stubbornly clung on to the point a while longer. "It’s in my top five.”
“I’m sure you’ll survive, husband. Now then, I have meetings all afternoon, so why don't you finish reviewing the menu? You’ll feel better when all this is over and you can go back to cooking, chess, or starting that eeeyiy club… You might even give Ce’lani a call or message her?” She gathered her coat and smiled demurely, though it harbored nothing innocent. “If I’m not here you’ll have perfect privacy… Just don't promise anything you wouldn't promise to me.”
“It’s iai-do…” Tom groused, but he was already picking up his omni-pad.
She blew him a kiss and made her way toward the commons. Tom would probably stew a while, but he’d make the call.
There would be time to meet with Ce’lani on the common, before she had to come home for dinner.
_ _ _
Tom looked over the banquet menu as if it might reach out and bite him. The words stared up at him with perfect innocence.
Appetizer: Fruit and Cheese Platter - Slices of various cheeses and fruits on a platter providing a delicate mix of sweet, tangy and creamy to invigorate the dining experience. Serve with a selection of sweet and semi-sweet wines.
Soup: Choice of Tomato or French Onion Soup - Served with a piece of baguette and cheese.
Salad: Strawberry Salad with Poppy Seed Dressing -- an assortment of greens and fruit with a balsamic grain dressing to cleanse the palate.
Entree: Cornish Pasty - This herb-infused meat and pastry dish provides a counterpoint to the tangy taste of the salad and soup. Served with a creamy buttered mashed potato (a vegetable, humanely prepared!) with chives (also a vegetable). Served with a selection of wines or ales.
Dessert: Chef’s Sorbet Surprise - A sweet treat complemented by a palate cleanser, ending the meal on a piquant note.
His last call with Bherdin had been a trial and a half. Omni-pads were the definition of ‘high fidelity’, and hearing the little Shil’vati hyperventilate for ten minutes over the plan was pointless. At least Melondi had easier going with Vedeem on her side... one way or another this was happening.
As a final consolation, he relented on wearing matching suits. Bherdin frequently bemoaned Tom’s 'lamentable' fashion sense, and he perked up at that, promising to get him some appropriate formalwear for the occasion.
Privately, he suspected his Shil’vati friend was looking for a convenient alibi if a riot started.
In fairness, it probably wasn't a bad idea.
“Too late to use it myself…” he muttered. It wasn’t quite noon, and Miv was probably right. Instead of Chess Club or starting Iai-do practice or just cooking out at Human Food, he was stuck here at home. Miv’s place was bigger, but most of his stuff was still in boxes; it left him listless and climbing the walls. If this worked, at least things could get back to normal.
…Mostly normal…
He flipped back to the picture of the Warden uniform on his omni-pad. It was bad enough, but the hat made the whole thing look like a blue toadstool in silver filigree.
He swiped the picture away like an act of revenge, but didn’t toss the pad back on the table.
…Miv was right... and I promised to call Ce’lani…
Tom centered himself, pulling up the number. The universe was always in motion and a good Taoist accepted their part in what came. That was the lesson of ‘the Vinegar Tasters’, and it held true… The painting showed three men standing around a vat of vinegar. Each has dipped his finger into the vinegar and tasted it. The expression on each man's face showed his individual reaction.
The painting was an allegory for Confucius, Buddha, and Lao-tse. Confucius wore a sour look on his face. He believed life was out of harmony with the universe. As the second figure in the painting, Buddha had a bitter expression. Like the vinegar, life was painful and filled with attachments and desires that led to suffering. The last man, Lao-tse, was smiling at the taste. To him, harmony existed naturally and could be found by anyone at any time in any experience.
He thought about his buddy Dave. The old Marine would probably shake his head and tell him to ‘embrace the suck.’ It pretty much boiled down to the same thing.
Not that he was against calling. Miv and Lea had practically taken turns urging him on and giving their views on why it was a good idea. They hadn't harped about it, but he knew which way the wind was blowing. And Ce’lani’s message had been short, sweet in the literal sense, and the sound file she’d offered up had been…
…Pretty nice, really…
If he still said no, or decided he didn't like where this was going, they’d back his choice, of course. He didn't have a doubt in his mind… But with everything else in his life turned upside down, calling Ce’lani seemed like a calm in the eye of a storm.
…It's just a phone call. Leave the chaos at the gate…
He settled down on the couch to check his messages before giving her a call. It was nearly lunch…
