Well this was suggested for me to do considering the desperate circumstances I find myself in. I'm looking for Paypal or CashApp or Zelle donations to use for a $5,000 retainer to hire legal counsel! And here's why...
I will be brutally honest even though the truth may turn people from wanting to help due to the stigma and stereotypical mind sets people seem to carry towards those that suffer from drug addiction and mental health issues. I suffer from a mental health diagnosis called shizo-effective depressive type. I also had a heroin addiction for many many years. In 2017 I had been on methodone for several years at a 50mg daily dose at your local friendly methodone clinic. I also drank daily, Id buy a fifth of Captain Morgan on my way home from work everyday. Id drink about 3/4 of this fifth daily after work. For years this went on all the while I worked doing basement waterproofing 6 days a week, running a jack hammer daily or digging huge deep holes around the outside perimeter of homes. I rented a small apartment a mile away from the beach, had a live in girlfriend, paid all my bills with simply one paycheck out of the monthly 4 pay cycles. Life was seemingly perfect! Compared to my earlier years of homelessness and heroin addiction. Slept in abandoned houses on the east side of Detroit, drug houses, homeless shelters and warming centers in the winter months. I committed retail frauds daily to support my drug habit, to eat, to support every financial need I had. Inevitably I did alot of time in county jails. Visited over 12 county jails and was a repeat customer at several of the jails. I spent approximately 5-6 years incarcerated in county jails. Then despite my crimes being non-violent, petty in nature, low class misdemeanors and felonies... The judges grew tired of my revolving door antics seemingly serving 90 days in jail out for 90 back in for 90 for over 5 years this went on. With quite a few 6 month sentences and a couple 1 year sentences. After being viewed as a career criminal with no regard for the law I was sent to prison, twice actually! I served almost 6 years total with the M.D.O.C. AKA Michigan prisons. For a grand tally of almost 11 years of incarceration on the installment plan, in pieces not straight 11 years. Moving forward I got out in 2012 and turned over a new leaf after serving 3 years for stealing 10 cans of baby formula from the local Kroger market. I went on what they call M.A.T. (medicated assisted treatment) methodone. This is viewed as a "harm reduction" module, basically for the severely addicted that have a very difficult time accumulating any clean time what so ever! Methodone gave me what I imagine people would refer to as a normal life. I worked, I rented a place, I paid bills, I was a productive member of society for the first time in my life at age 30. I landed a job with the local 687 carpenters union out of Detroit worked as an apprentice on commercial cooling towers. I attended apprenticeship school, or trade school once a week for 8 hrs and collected $19 an hr to sit in class. I had a pension, an annuity, top class health insurance with an Express Scripts debit card that collected $120 a month to use toward prescriptions, doctor appts, copays etc. Life was grand I was finally proving myself to be more than the stereotyped street addict career criminal. Moving forward the carpenters union didn't pan out and unfortunately wasn't vested enough to collect any of my pension I paid into, my employer paid into for over a year. I then got into Basement Waterproofing and stuck with this trade from there on out. Well in the year 2017, 5 years out of prison now and heroin free I became ... What's the perfect adjective to use here... Complacent I suppose. Life was good had all I wanted, never went w/o. Even had the live in girlfriend situation going. Learning to step outside of my own selfish self-centered geared mentality. Into a loving compassionate individual that did my best to provide, support, love another human being. This was foreign territory for me absolutely! As before the world evolved around me me me. Safe to say I was growing and learning to live "normal" (despise that reference but seemingly fits here). I in fact was doing so well I decided I no longer needed to be on methodone and if I'm gonna stop that I may as well not drink either! I cold turkey approached a 50mg daily 5 year dose of methodone and quit drinking almost the daily fifth of Captain Morgan Spiced Rum. Now here in lies the confliction and perhaps even someone could view as controversial because I claimed to be growing and living my best life yet I was taking a strong narcotic medication and drinking daily on it! However I view this in a relative standpoint, in comparison to the way I lived prior ... Street junky retail fraud extradenair in and out of incarceration, not to mention around 20 inpatient substance abuse rehabilitation centers. So in comparison to that lifestyle I did view myself as experiencing "my best years." In fact I would still argue that logic, despite my own mother not seeing it in that perspective. Which brings me into mental health and my schizo-effective major depressive and substance abuse severe diagnosis. The classic coined term Dual Diagnosis, suffering from drug addiction and mental health issues. So to back it up briefly and quickly move forward with this because I'm honestly not wanting this to be long in the sense of people dont even contemplate reading it. But yes my decision to quit drinking and abruptly quit methodone against doctors advice to gradually wean down to a near 0mg dosage . I had made up my mind and couldn't of been more ready to see this thing thru! Well I'd say it was 10 days into my detox (methodone is a long drawn out detox due to a "half-life" term that basically means the medication builds up in your system and takes forever to not only complete a detox, but to simply feel like your self again) it gets in your bone marrow and does NOT see itself out as normally as say other drugs would! In fact I would argue that after being on methodone long term that you never fully recover from that. Simply put you never quite feel the same again, that the daily "norm feeling" is far from normal anymore. It is common knowledge that fatigue, depression, and for me, being in a never-ending state of not ever again experiencing pleasure in mundane things that (here we go again) normal people find joy in. There is no drive to do anything, to go anywhere, or simply go out and enjoy the company of socializing and interacting with other people, even loved ones. Simply put it is very difficult to find pleasure in anything, with no high or low emotions rather like being stuck at a constant medium. Combine that with chronic fatigue and a general baseline of feeling depressed. That is what it is like to come off a synthetic opiate that you took daily for 5 years or better! But I haven't even started on the mental health aspects of my experience. Back to the point of being about 10 days into my detox... I experienced what they call a drug induced psychosis. Which was basically like being schizophrenic but times 10. I was in such a state that when I watched T. V. I was being sent subliminal messages from corporate America trying to indirectly turn me on to something that was extremely important but yet no matter how hard I tried I couldn't understand "what the TV was truly trying to tell me." When I put music on I was convinced that the artists I was listening to had a direct feed into my personal life and were rapping about me, again sending me messages. When I walked down the street the traffic in the road was deliberately trying to lead me somewhere that I needed to follow or sometimes avoid. I mean it is very difficult for me to put in words what I experienced because it's like trying to write something that makes absolutely no sense, but then try to make the reader understand what I was experiencing and trying to explain. Another thing I recall was people around me in stores or wherever they would be on there cell phones talking but they weren't actually talking to anyone on their phones they were indirectly talking to me. Ill stop there with the attempted explanation of what a psychosis was like, I'm sure the reader can see it's basically going from never having any psychological issues to becoming absolutely crazy! It's like the most intense self-centered experience one could ever go thru. As everything, the traffic, people, music, television literally everything surrounding you is directed at you! As if the entire world is circulating around you because everything that happens has to do with someone or something directing a message or a signal to you. Basically I lost my fuckin mind ok. I went from never having any mental health issues perhaps a little situational depression due to my life choices, my addiction, being incarcerated etc. But nothing worthy of note nothing pre-existing here that got triggered in my detox. It wasn't like that, I wasn't previously even slightly off my rocker then thru detox it enhanced it. No it was more like being completely normal experiencing what I was considering my best life to being completely utterly insane! So naturally 3 weeks into this I had lost my job, my car broke down, and I wasn't leaving my apartment at all. It progressed and got worse for a period of, no exaggeration here, almost 3 years. I moved back in with my mother and step father in 2017. Having lost everything I worked for and accumulated, even my pets! My family thought I was gone beyond repair that I would never be myself again. I went to the psychiatric hospital a few times and they couldnt even explain what had happened or the why I ended up in such a long state of insanity. Id say it was about 2020 at which point community mental health workers had been coming to my mom's place 3 times a week to check in on me. I had been taking a medication called Abilify for quite some time at this point. And I don't know hard to elaborate on but I just kinda started to snap out of it. Then eventually I did completely snap out of it and I was wonderfully sane and capable of sitting down and having a rational conversation again. The catch was severe depression lingered, a depression that was more intense than the horrible adjustment phase of not having methodone to jump start brain synapses, and working with a completely deleted amount of dopamine and serotonin levels. It became my personality a general baseline of depressed. Sane again yes but depressed to the extreme of finding little to no pleasure in doing things. Sleeping 12 hours a day, chronic fatigue... Basically discontented at all times. At this point of my life I had been out of prison for 11 years, had 0 police contact, no problems with drug abuse at least not on the level of being anything remotely close to a street junky.
So this turned out to be way longer and more detailed then I had originally intended this to go. I'm writing this for a purpose because I am currently in trouble and I honestly do need financial assistance to acquire legal representation. A situation I never ever thought I would be in again. As I had over 10 + years outside of living in such a miserable existence of constantly worrying about being incarcerated or worrying about my next fix. So anyway I'm sharing my story here to first of all present an honest persective into my life. Yes I struggled for many years but I never once went into the how i got into heroin at age 17. I didn't play the point my finger at the adult game that turned me and my best friend onto the drug telling us it was only ketamine that is essentially non addictive. That I used heroin for the duration of a year before I new it was heroin. Finding out too late because I was already in a state of being chemically dependent. That it was in fact my best friend thru middle and high school, his older brother that turned us onto becoming junkies and mislead the whole way into thinking we were doing a drug that doesn't have serious addictive properties. I mean there are so many blame games I coulda orchestrated in this writing, perhaps sharing my own father being a crack addict that routinely embarrassed me in high school by going on crack binges then coming over to like my girlfriends house and trying to manipulate money outta them. Or having me in the car with him as a kid while he smoked crack telling me to turn my head while he blasted away 50 dollar rocks filling the entire car with crack smoke. My point is yes there was learned behaviors I picked up at an early age that perhaps made me more susceptible to turning out the way I did. Or the trauma I experienced as a child that had me running to drugs to get high at 13 years old. There were so many contributing factors but the simple truth is despite all that stuff, the trauma and learned behaviors all the things the licensed therapists will play on and then tell u it's not your fault. Well I kinda disagree with all that because no one forced me to do the things I did, I made a conscious decision every day in doing the things I did until it completely spiraled outta control and my life became completely unmanageable. Textbook powerlessness over the ability to simply say no and to just stop using. I couldn't do that, I still can't do that I have to be on medication to balance myself out if I'm not using. Because I dont feel normal or happy when I'm not on my medicine in fact I'm out right miserable. Which brings me to the current perdictment I'm in, with the legal issues. To get to the point of summing this up after 12 years of no legal trouble I did end up being charged with a felony. I had given an old friend a ride and he stashed a meth pipe in my truck, that had been there for over 6 months without my knowledge until the day came where I was pulled over. And with my history when I get pulled over they search my vehicle every time! And yes this happened and they find this meth pipe and apparently meth is like the worse drug in the world to be charged with. Over having a meth pipe in my truck I was charged with felony possession of methinphetamines. I go to court and because of my past the charges from over 12 years ago, it enhanced my sentencing guidelines. I was told I was going to do anywhere from 5 months to 41 months, for this pipe found that wasn't even mine. And it mattered not that all this time had went by where I didn't get in trouble and did well for myself. So with looking at prison again, and having mental health problems now being a bit older and settled down... I completely panicked over the ideal of long term incarceration again. So I signed up for the mental health court program which is basically the same thing as drug court for those that are familiar. And I did 18 months on this program of seeing the judge every single week to check in with status reports. Going to take drug tests 3 times a week. Doing mandatory counseling 5 days a week at community mental health on top of seeing my recovery coach once a week and my therapist once a week. To top it off with 5 NA/AA meetings a week. I did all this for 18 months only had 6 months of this intense probation left to go. Then my uncle died of lung cancer and the man was like a father figure to me. I relapsed and I can't really explain the why, it was like I was in a state of just not caring being so lost with grief is a overbearing thing idk but yes I relapsed. I immediately told on myself, told my therapist told the judge told everyone on the mental health team. And the judge was not happy I told her I had a rehab set up and I could get in that very next day. I went on to tell her that there was a 90 day program they offered at this facility and I was aiming to get into that. She then completely cut me off said I was to go there I was to do not a day less than 90 and if I deveaated in any way she would take me off this jail diversion mental health program that I would be resentenced on original charge and basically it wouldn't be good! And I do know from experience in my dealings with the judicial system and being around other inmates hearing there stories, that when put into one of these jail diversion/ sentence diversion programs like mental health court or drug court.. that if you sign up for it then end up messing it up not completing for whatever reason that they go to the very high end of your sentencing guidelines and give you every bit of time they are permitted to according to your scoring sheet.
Coming to conclusion here I went to this program and IMMEDIATELY found out that the 90 day program they offered was merely for a select few individuals that there was never bed space to get into it and unfortunately you had to of been from that same county receiving funding from that particular county in order to get accepted into it! So I was a far ways off from even being remotely close to being eligible for this 90 day program that my judge demanded me to do. Then I find out my program is only a 2 week program which is a far ways off from 90. And I knew my judge wasn't gonna wanna hear any kinda excuses or reasons. So what I did was I did 2 weeks then I applied for 2 week extensions at the end of my 2 week funding period. Long story short here I got 7 weeks in and then my funding source decided that was sufficient and I wasn't getting anymore funding for additional time there in the program. So I panicked and I ended up calling medicaid switching my address to a local address then I called the local funding source for inpatient rehabs and I gave them this new local address. Well they issued me more funding to stay and I thought I was good, no worries. Few days later I'm being told that I have to zoom in for mental health court that day which was not routine at all as I had been there 8 weeks almost at that point and never had to zoom in because the judge new I was in rehab. So I zoom in to court the judge tells me that I'm to leave the rehab and report immediately the following Tuesday to court for resentencing that I was being kicked of the program because I was no longer a resident of Lapeer county. I tried to explain and I was shunned wasnt allowed to explain then I got hung up on whole on the zoom app. I immediately call my therapist because she's part of the mental health court team. She tells me that in changing my address and using it to fasely acquire funding for medical services in a fraudant way was in fact a felony. Then she said that she was sorry but there was nothing she could do for me that the judge was gonna resentence me. So my life flipped upside down immediately here I am in rehab going on almost 8 weeks doing great participating the best I could attempting to get the most I could outta the experience so I could get out stay clean and move forward with my life and be off the court probation thing it under 6 months. To my reality becoming I'm not going to do 41 months in prison over a meth pipe which is technically a paraphernalia ticket but they trumped it up to a felony and now I have to go back after 12 years of being out. I stressed and stressed and stressed then I ran. I didn't go to court because honestly I'm scared to death over the idea of going back to prison. I struggle with mental health problem now, I'm older and simply just not the young healthy person l was when I had to go in last time! I convinced myself that I wouldn't mentally be capable of enduring that again in the current state of my well-being. And I left the trailer I own because staying there woulda been me being arrested with in a week. So now here I am staying with a friend no money no job no where to go family mad at me and im looking at 41 months :( .
I need help I'm trying to raise 5 grand to retain this lawyer that already knows the ins and outs of my whole case. And believe he can get me a deal to no prison time! Which is a miracle because as of now I'm looking at 41 months! So we're talking roughly 30 months being shaved off for an expense of 5 grand! That is worth the money it's worth me doing something like this that I would under normal circumstances not even think about writing my personal life to be painted on the internet for the world to see. And maybe just maybe a few individuals out there that have the means to help people financially will read this and decide I've suffered enough in my life time already and won't wanna see me go do 41 months in prison!

The history of all hitherto existing society is the history of class struggles.
Freeman and slave, patrician and plebeian, lord and serf, guild-master and journeyman, in a word, oppressor and oppressed, stood in constant opposition to one another, carried on an uninterrupted, now hidden, now open fight, a fight that each time ended, either in a revolutionary reconstitution of society at large, or in the common ruin of the contending classes.
In the earlier epochs of history, we find almost everywhere a complicated arrangement of society into various orders, a manifold gradation of social rank. In ancient Rome we have patricians, knights, plebeians, slaves; in the Middle Ages, feudal lords, vassals, guild-masters, journeymen, apprentices, serfs; in almost all of these classes, again, subordinate gradations.
The modern bourgeois society that has sprouted from the ruins of feudal society has not done away with class antagonisms. It has but established new classes, new conditions of oppression, new forms of struggle in place of the old ones.
Our epoch, the epoch of the bourgeoisie, possesses, however, this distinct feature: it has simplified class antagonisms. Society as a whole is more and more splitting up into two great hostile camps, into two great classes directly facing each other — Bourgeoisie and Proletariat.
From the serfs of the Middle Ages sprang the chartered burghers of the earliest towns. From these burgesses the first elements of the bourgeoisie were developed.
The discovery of America, the rounding of the Cape, opened up fresh ground for the rising bourgeoisie. The East-Indian and Chinese markets, the colonisation of America, trade with the colonies, the increase in the means of exchange and in commodities generally, gave to commerce, to navigation, to industry, an impulse never before known, and thereby, to the revolutionary element in the tottering feudal society, a rapid development.
The feudal system of industry, in which industrial production was monopolised by closed guilds, now no longer sufficed for the growing wants of the new markets. The manufacturing system took its place. The guild-masters were pushed on one side by the manufacturing middle class; division of labour between the different corporate guilds vanished in the face of division of labour in each single workshop.
Meantime the markets kept ever growing, the demand ever rising. Even manufacturer no longer sufficed. Thereupon, steam and machinery revolutionised industrial production. The place of manufacture was taken by the giant, Modern Industry; the place of the industrial middle class by industrial millionaires, the leaders of the whole industrial armies, the modern bourgeois.
Modern industry has established the world market, for which the discovery of America paved the way. This market has given an immense development to commerce, to navigation, to communication by land. This development has, in its turn, reacted on the extension of industry; and in proportion as industry, commerce, navigation, railways extended, in the same proportion the bourgeoisie developed, increased its capital, and pushed into the background every class handed down from the Middle Ages.
We see, therefore, how the modern bourgeoisie is itself the product of a long course of development, of a series of revolutions in the modes of production and of exchange.
Each step in the development of the bourgeoisie was accompanied by a corresponding political advance of that class. An oppressed class under the sway of the feudal nobility, an armed and self-governing association in the medieval commune(4): here independent urban republic (as in Italy and Germany); there taxable “third estate” of the monarchy (as in France); afterwards, in the period of manufacturing proper, serving either the semi-feudal or the absolute monarchy as a counterpoise against the nobility, and, in fact, cornerstone of the great monarchies in general, the bourgeoisie has at last, since the establishment of Modern Industry and of the world market, conquered for itself, in the modern representative State, exclusive political sway. The executive of the modern state is but a committee for managing the common affairs of the whole bourgeoisie.
The bourgeoisie, historically, has played a most revolutionary part.
The bourgeoisie, wherever it has got the upper hand, has put an end to all feudal, patriarchal, idyllic relations. It has pitilessly torn asunder the motley feudal ties that bound man to his “natural superiors”, and has left remaining no other nexus between man and man than naked self-interest, than callous “cash payment”. It has drowned the most heavenly ecstasies of religious fervour, of chivalrous enthusiasm, of philistine sentimentalism, in the icy water of egotistical calculation. It has resolved personal worth into exchange value, and in place of the numberless indefeasible chartered freedoms, has set up that single, unconscionable freedom — Free Trade. In one word, for exploitation, veiled by religious and political illusions, it has substituted naked, shameless, direct, brutal exploitation.
The bourgeoisie has stripped of its halo every occupation hitherto honoured and looked up to with reverent awe. It has converted the physician, the lawyer, the priest, the poet, the man of science, into its paid wage labourers.
The bourgeoisie has torn away from the family its sentimental veil, and has reduced the family relation to a mere money relation.
The bourgeoisie has disclosed how it came to pass that the brutal display of vigour in the Middle Ages, which reactionaries so much admire, found its fitting complement in the most slothful indolence. It has been the first to show what man’s activity can bring about. It has accomplished wonders far surpassing Egyptian pyramids, Roman aqueducts, and Gothic cathedrals; it has conducted expeditions that put in the shade all former Exoduses of nations and crusades.
The bourgeoisie cannot exist without constantly revolutionising the instruments of production, and thereby the relations of production, and with them the whole relations of society. Conservation of the old modes of production in unaltered form, was, on the contrary, the first condition of existence for all earlier industrial classes. Constant revolutionising of production, uninterrupted disturbance of all social conditions, everlasting uncertainty and agitation distinguish the bourgeois epoch from all earlier ones. All fixed, fast-frozen relations, with their train of ancient and venerable prejudices and opinions, are swept away, all new-formed ones become antiquated before they can ossify. All that is solid melts into air, all that is holy is profaned, and man is at last compelled to face with sober senses his real conditions of life, and his relations with his kind.
The need of a constantly expanding market for its products chases the bourgeoisie over the entire surface of the globe. It must nestle everywhere, settle everywhere, establish connexions everywhere.
The bourgeoisie has through its exploitation of the world market given a cosmopolitan character to production and consumption in every country. To the great chagrin of Reactionists, it has drawn from under the feet of industry the national ground on which it stood. All old-established national industries have been destroyed or are daily being destroyed. They are dislodged by new industries, whose introduction becomes a life and death question for all civilised nations, by industries that no longer work up indigenous raw material, but raw material drawn from the remotest zones; industries whose products are consumed, not only at home, but in every quarter of the globe. In place of the old wants, satisfied by the production of the country, we find new wants, requiring for their satisfaction the products of distant lands and climes. In place of the old local and national seclusion and self-sufficiency, we have intercourse in every direction, universal inter-dependence of nations. And as in material, so also in intellectual production. The intellectual creations of individual nations become common property. National one-sidedness and narrow-mindedness become more and more impossible, and from the numerous national and local literatures, there arises a world literature.
The bourgeoisie, by the rapid improvement of all instruments of production, by the immensely facilitated means of communication, draws all, even the most barbarian, nations into civilisation. The cheap prices of commodities are the heavy artillery with which it batters down all Chinese walls, with which it forces the barbarians’ intensely obstinate hatred of foreigners to capitulate. It compels all nations, on pain of extinction, to adopt the bourgeois mode of production; it compels them to introduce what it calls civilisation into their midst, i.e., to become bourgeois themselves. In one word, it creates a world after its own image.
The bourgeoisie has subjected the country to the rule of the towns. It has created enormous cities, has greatly increased the urban population as compared with the rural, and has thus rescued a considerable part of the population from the idiocy of rural life. Just as it has made the country dependent on the towns, so it has made barbarian and semi-barbarian countries dependent on the civilised ones, nations of peasants on nations of bourgeois, the East on the West.
The bourgeoisie keeps more and more doing away with the scattered state of the population, of the means of production, and of property. It has agglomerated population, centralised the means of production, and has concentrated property in a few hands. The necessary consequence of this was political centralisation. Independent, or but loosely connected provinces, with separate interests, laws, governments, and systems of taxation, became lumped together into one nation, with one government, one code of laws, one national class-interest, one frontier, and one customs-tariff.
The bourgeoisie, during its rule of scarce one hundred years, has created more massive and more colossal productive forces than have all preceding generations together. Subjection of Nature’s forces to man, machinery, application of chemistry to industry and agriculture, steam-navigation, railways, electric telegraphs, clearing of whole continents for cultivation, canalisation of rivers, whole populations conjured out of the ground — what earlier century had even a presentiment that such productive forces slumbered in the lap of social labour?
We see then: the means of production and of exchange, on whose foundation the bourgeoisie built itself up, were generated in feudal society. At a certain stage in the development of these means of production and of exchange, the conditions under which feudal society produced and exchanged, the feudal organisation of agriculture and manufacturing industry, in one word, the feudal relations of property became no longer compatible with the already developed productive forces; they became so many fetters. They had to be burst asunder; they were burst asunder.
Into their place stepped free competition, accompanied by a social and political constitution adapted in it, and the economic and political sway of the bourgeois class.
A similar movement is going on before our own eyes. Modern bourgeois society, with its relations of production, of exchange and of property, a society that has conjured up such gigantic means of production and of exchange, is like the sorcerer who is no longer able to control the powers of the nether world whom he has called up by his spells. For many a decade past the history of industry and commerce is but the history of the revolt of modern productive forces against modern conditions of production, against the property relations that are the conditions for the existence of the bourgeois and of its rule. It is enough to mention the commercial crises that by their periodical return put the existence of the entire bourgeois society on its trial, each time more threateningly. In these crises, a great part not only of the existing products, but also of the previously created productive forces, are periodically destroyed. In these crises, there breaks out an epidemic that, in all earlier epochs, would have seemed an absurdity — the epidemic of over-production. Society suddenly finds itself put back into a state of momentary barbarism; it appears as if a famine, a universal war of devastation, had cut off the supply of every means of subsistence; industry and commerce seem to be destroyed; and why? Because there is too much civilisation, too much means of subsistence, too much industry, too much commerce. The productive forces at the disposal of society no longer tend to further the development of the conditions of bourgeois property; on the contrary, they have become too powerful for these conditions, by which they are fettered, and so soon as they overcome these fetters, they bring disorder into the whole of bourgeois society, endanger the existence of bourgeois property. The conditions of bourgeois society are too narrow to comprise the wealth created by them. And how does the bourgeoisie get over these crises? On the one hand by enforced destruction of a mass of productive forces; on the other, by the conquest of new markets, and by the more thorough exploitation of the old ones. That is to say, by paving the way for more extensive and more destructive crises, and by diminishing the means whereby crises are prevented.
The weapons with which the bourgeoisie felled feudalism to the ground are now turned against the bourgeoisie itself.
But not only has the bourgeoisie forged the weapons that bring death to itself; it has also called into existence the men who are to wield those weapons — the modern working class — the proletarians.
In proportion as the bourgeoisie, i.e., capital, is developed, in the same proportion is the proletariat, the modern working class, developed — a class of labourers, who live only so long as they find work, and who find work only so long as their labour increases capital. These labourers, who must sell themselves piecemeal, are a commodity, like every other article of commerce, and are consequently exposed to all the vicissitudes of competition, to all the fluctuations of the market.
Owing to the extensive use of machinery, and to the division of labour, the work of the proletarians has lost all individual character, and, consequently, all charm for the workman. He becomes an appendage of the machine, and it is only the most simple, most monotonous, and most easily acquired knack, that is required of him. Hence, the cost of production of a workman is restricted, almost entirely, to the means of subsistence that he requires for maintenance, and for the propagation of his race. But the price of a commodity, and therefore also of labour, is equal to its cost of production. In proportion, therefore, as the repulsiveness of the work increases, the wage decreases. Nay more, in proportion as the use of machinery and division of labour increases, in the same proportion the burden of toil also increases, whether by prolongation of the working hours, by the increase of the work exacted in a given time or by increased speed of machinery, etc.
Modern Industry has converted the little workshop of the patriarchal master into the great factory of the industrial capitalist. Masses of labourers, crowded into the factory, are organised like soldiers. As privates of the industrial army they are placed under the command of a perfect hierarchy of officers and sergeants. Not only are they slaves of the bourgeois class, and of the bourgeois State; they are daily and hourly enslaved by the machine, by the overlooker, and, above all, by the individual bourgeois manufacturer himself. The more openly this despotism proclaims gain to be its end and aim, the more petty, the more hateful and the more embittering it is.
The less the skill and exertion of strength implied in manual labour, in other words, the more modern industry becomes developed, the more is the labour of men superseded by that of women. Differences of age and sex have no longer any distinctive social validity for the working class. All are instruments of labour, more or less expensive to use, according to their age and sex.
No sooner is the exploitation of the labourer by the manufacturer, so far, at an end, that he receives his wages in cash, than he is set upon by the other portions of the bourgeoisie, the landlord, the shopkeeper, the pawnbroker, etc.
The lower strata of the middle class — the small tradespeople, shopkeepers, and retired tradesmen generally, the handicraftsmen and peasants — all these sink gradually into the proletariat, partly because their diminutive capital does not suffice for the scale on which Modern Industry is carried on, and is swamped in the competition with the large capitalists, partly because their specialised skill is rendered worthless by new methods of production. Thus the proletariat is recruited from all classes of the population.
The proletariat goes through various stages of development. With its birth begins its struggle with the bourgeoisie. At first the contest is carried on by individual labourers, then by the workpeople of a factory, then by the operative of one trade, in one locality, against the individual bourgeois who directly exploits them. They direct their attacks not against the bourgeois conditions of production, but against the instruments of production themselves; they destroy imported wares that compete with their labour, they smash to pieces machinery, they set factories ablaze, they seek to restore by force the vanished status of the workman of the Middle Ages.
At this stage, the labourers still form an incoherent mass scattered over the whole country, and broken up by their mutual competition. If anywhere they unite to form more compact bodies, this is not yet the consequence of their own active union, but of the union of the bourgeoisie, which class, in order to attain its own political ends, is compelled to set the whole proletariat in motion, and is moreover yet, for a time, able to do so. At this stage, therefore, the proletarians do not fight their enemies, but the enemies of their enemies, the remnants of absolute monarchy, the landowners, the non-industrial bourgeois, the petty bourgeois. Thus, the whole historical movement is concentrated in the hands of the bourgeoisie; every victory so obtained is a victory for the bourgeoisie.
But with the development of industry, the proletariat not only increases in number; it becomes concentrated in greater masses, its strength grows, and it feels that strength more. The various interests and conditions of life within the ranks of the proletariat are more and more equalised, in proportion as machinery obliterates all distinctions of labour, and nearly everywhere reduces wages to the same low level. The growing competition among the bourgeois, and the resulting commercial crises, make the wages of the workers ever more fluctuating. The increasing improvement of machinery, ever more rapidly developing, makes their livelihood more and more precarious; the collisions between individual workmen and individual bourgeois take more and more the character of collisions between two classes. Thereupon, the workers begin to form combinations (Trades’ Unions) against the bourgeois; they club together in order to keep up the rate of wages; they found permanent associations in order to make provision beforehand for these occasional revolts. Here and there, the contest breaks out into riots.
Now and then the workers are victorious, but only for a time. The real fruit of their battles lies, not in the immediate result, but in the ever expanding union of the workers. This union is helped on by the improved means of communication that are created by modern industry, and that place the workers of different localities in contact with one another. It was just this contact that was needed to centralise the numerous local struggles, all of the same character, into one national struggle between classes. But every class struggle is a political struggle. And that union, to attain which the burghers of the Middle Ages, with their miserable highways, required centuries, the modern proletarian, thanks to railways, achieve in a few years.
This organisation of the proletarians into a class, and, consequently into a political party, is continually being upset again by the competition between the workers themselves. But it ever rises up again, stronger, firmer, mightier. It compels legislative recognition of particular interests of the workers, by taking advantage of the divisions among the bourgeoisie itself. Thus, the ten-hours’ bill in England was carried.
Altogether collisions between the classes of the old society further, in many ways, the course of development of the proletariat. The bourgeoisie finds itself involved in a constant battle. At first with the aristocracy; later on, with those portions of the bourgeoisie itself, whose interests have become antagonistic to the progress of industry; at all time with the bourgeoisie of foreign countries. In all these battles, it sees itself compelled to appeal to the proletariat, to ask for help, and thus, to drag it into the political arena. The bourgeoisie itself, therefore, supplies the proletariat with its own elements of political and general education, in other words, it furnishes the proletariat with weapons for fighting the bourgeoisie.
Further, as we have already seen, entire sections of the ruling class are, by the advance of industry, precipitated into the proletariat, or are at least threatened in their conditions of existence. These also supply the proletariat with fresh elements of enlightenment and progress.
Finally, in times when the class struggle nears the decisive hour, the progress of dissolution going on within the ruling class, in fact within the whole range of old society, assumes such a violent, glaring character, that a small section of the ruling class cuts itself adrift, and joins the revolutionary class, the class that holds the future in its hands. Just as, therefore, at an earlier period, a section of the nobility went over to the bourgeoisie, so now a portion of the bourgeoisie goes over to the proletariat, and in particular, a portion of the bourgeois ideologists, who have raised themselves to the level of comprehending theoretically the historical movement as a whole.
Of all the classes that stand face to face with the bourgeoisie today, the proletariat alone is a really revolutionary class. The other classes decay and finally disappear in the face of Modern Industry; the proletariat is its special and essential product.
The lower middle class, the small manufacturer, the shopkeeper, the artisan, the peasant, all these fight against the bourgeoisie, to save from extinction their existence as fractions of the middle class. They are therefore not revolutionary, but conservative. Nay more, they are reactionary, for they try to roll back the wheel of history. If by chance, they are revolutionary, they are only so in view of their impending transfer into the proletariat; they thus defend not their present, but their future interests, they desert their own standpoint to place themselves at that of the proletariat.
The “dangerous class”, [lumpenproletariat] the social scum, that passively rotting mass thrown off by the lowest layers of the old society, may, here and there, be swept into the movement by a proletarian revolution; its conditions of life, however, prepare it far more for the part of a bribed tool of reactionary intrigue.
In the condition of the proletariat, those of old society at large are already virtually swamped. The proletarian is without property; his relation to his wife and children has no longer anything in common with the bourgeois family relations; modern industry labour, modern subjection to capital, the same in England as in France, in America as in Germany, has stripped him of every trace of national character. Law, morality, religion, are to him so many bourgeois prejudices, behind which lurk in ambush just as many bourgeois interests.
All the preceding classes that got the upper hand sought to fortify their already acquired status by subjecting society at large to their conditions of appropriation. The proletarians cannot become masters of the productive forces of society, except by abolishing their own previous mode of appropriation, and thereby also every other previous mode of appropriation. They have nothing of their own to secure and to fortify; their mission is to destroy all previous securities for, and insurances of, individual property.
All previous historical movements were movements of minorities, or in the interest of minorities. The proletarian movement is the self-conscious, independent movement of the immense majority, in the interest of the immense majority. The proletariat, the lowest stratum of our present society, cannot stir, cannot raise itself up, without the whole superincumbent strata of official society being sprung into the air.
Though not in substance, yet in form, the struggle of the proletariat with the bourgeoisie is at first a national struggle. The proletariat of each country must, of course, first of all settle matters with its own bourgeoisie.
In depicting the most general phases of the development of the proletariat, we traced the more or less veiled civil war, raging within existing society, up to the point where that war breaks out into open revolution, and where the violent overthrow of the bourgeoisie lays the foundation for the sway of the proletariat.
Hitherto, every form of society has been based, as we have already seen, on the antagonism of oppressing and oppressed classes. But in order to oppress a class, certain conditions must be assured to it under which it can, at least, continue its slavish existence. The serf, in the period of serfdom, raised himself to membership in the commune, just as the petty bourgeois, under the yoke of the feudal absolutism, managed to develop into a bourgeois. The modern labourer, on the contrary, instead of rising with the process of industry, sinks deeper and deeper below the conditions of existence of his own class. He becomes a pauper, and pauperism develops more rapidly than population and wealth. And here it becomes evident, that the bourgeoisie is unfit any longer to be the ruling class in society, and to impose its conditions of existence upon society as an over-riding law. It is unfit to rule because it is incompetent to assure an existence to its slave within his slavery, because it cannot help letting him sink into such a state, that it has to feed him, instead of being fed by him. Society can no longer live under this bourgeoisie, in other words, its existence is no longer compatible with society.
The essential conditions for the existence and for the sway of the bourgeois class is the formation and augmentation of capital; the condition for capital is wage-labour. Wage-labour rests exclusively on competition between the labourers. The advance of industry, whose involuntary promoter is the bourgeoisie, replaces the isolation of the labourers, due to competition, by the revolutionary combination, due to association. The development of Modern Industry, therefore, cuts from under its feet the very foundation on which the bourgeoisie produces and appropriates products. What the bourgeoisie therefore produces, above all, are its own grave-diggers. Its fall and the victory of the proletariat are equally inevitable.

I will be brutally honest even though the truth may turn people from wanting to help due to the stigma and stereotypical mind sets people seem to carry towards those that suffer from drug addiction and mental health issues. I suffer from a mental health diagnosis called shizo-effective depressive type. I also had a heroin addiction for many many years. In 2017 I had been on methodone for several years at a 50mg daily dose at your local friendly methodone clinic. I also drank daily, Id buy a fifth of Captain Morgan on my way home from work everyday. Id drink about 3/4 of this fifth daily after work. For years this went on all the while I worked doing basement waterproofing 6 days a week, running a jack hammer daily or digging huge deep holes around the outside perimeter of homes. I rented a small apartment a mile away from the beach, had a live in girlfriend, paid all my bills with simply one paycheck out of the monthly 4 pay cycles. Life was seemingly perfect! Compared to my earlier years of homelessness and heroin addiction. Slept in abandoned houses on the east side of Detroit, drug houses, homeless shelters and warming centers in the winter months. I committed retail frauds daily to support my drug habit, to eat, to support every financial need I had. Inevitably I did alot of time in county jails. Visited over 12 county jails and was a repeat customer at several of the jails. I spent approximately 5-6 years incarcerated in county jails. Then despite my crimes being non-violent, petty in nature, low class misdemeanors and felonies... The judges grew tired of my revolving door antics seemingly serving 90 days in jail out for 90 back in for 90 for over 5 years this went on. With quite a few 6 month sentences and a couple 1 year sentences. After being viewed as a career criminal with no regard for the law I was sent to prison, twice actually! I served almost 6 years total with the M.D.O.C. AKA Michigan prisons. For a grand tally of almost 11 years of incarceration on the installment plan, in pieces not straight 11 years. Moving forward I got out in 2012 and turned over a new leaf after serving 3 years for stealing 10 cans of baby formula from the local Kroger market. I went on what they call M.A.T. (medicated assisted treatment) methodone. This is viewed as a "harm reduction" module, basically for the severely addicted that have a very difficult time accumulating any clean time what so ever! Methodone gave me what I imagine people would refer to as a normal life. I worked, I rented a place, I paid bills, I was a productive member of society for the first time in my life at age 30. I landed a job with the local 687 carpenters union out of Detroit worked as an apprentice on commercial cooling towers. I attended apprenticeship school, or trade school once a week for 8 hrs and collected $19 an hr to sit in class. I had a pension, an annuity, top class health insurance with an Express Scripts debit card that collected $120 a month to use toward prescriptions, doctor appts, copays etc. Life was grand I was finally proving myself to be more than the stereotyped street addict career criminal. Moving forward the carpenters union didn't pan out and unfortunately wasn't vested enough to collect any of my pension I paid into, my employer paid into for over a year. I then got into Basement Waterproofing and stuck with this trade from there on out. Well in the year 2017, 5 years out of prison now and heroin free I became ... What's the perfect adjective to use here... Complacent I suppose. Life was good had all I wanted, never went w/o. Even had the live in girlfriend situation going. Learning to step outside of my own selfish self-centered geared mentality. Into a loving compassionate individual that did my best to provide, support, love another human being. This was foreign territory for me absolutely! As before the world evolved around me me me. Safe to say I was growing and learning to live "normal" (despise that reference but seemingly fits here). I in fact was doing so well I decided I no longer needed to be on methodone and if I'm gonna stop that I may as well not drink either! I cold turkey approached a 50mg daily 5 year dose of methodone and quit drinking almost the daily fifth of Captain Morgan Spiced Rum. Now here in lies the confliction and perhaps even someone could view as controversial because I claimed to be growing and living my best life yet I was taking a strong narcotic medication and drinking daily on it! However I view this in a relative standpoint, in comparison to the way I lived prior ... Street junky retail fraud extradenair in and out of incarceration, not to mention around 20 inpatient substance abuse rehabilitation centers. So in comparison to that lifestyle I did view myself as experiencing "my best years." In fact I would still argue that logic, despite my own mother not seeing it in that perspective. Which brings me into mental health and my schizo-effective major depressive and substance abuse severe diagnosis. The classic coined term Dual Diagnosis, suffering from drug addiction and mental health issues. So to back it up briefly and quickly move forward with this because I'm honestly not wanting this to be long in the sense of people dont even contemplate reading it. But yes my decision to quit drinking and abruptly quit methodone against doctors advice to gradually wean down to a near 0mg dosage . I had made up my mind and couldn't of been more ready to see this thing thru! Well I'd say it was 10 days into my detox (methodone is a long drawn out detox due to a "half-life" term that basically means the medication builds up in your system and takes forever to not only complete a detox, but to simply feel like your self again) it gets in your bone marrow and does NOT see itself out as normally as say other drugs would! In fact I would argue that after being on methodone long term that you never fully recover from that. Simply put you never quite feel the same again, that the daily "norm feeling" is far from normal anymore. It is common knowledge that fatigue, depression, and for me, being in a never-ending state of not ever again experiencing pleasure in mundane things that (here we go again) normal people find joy in. There is no drive to do anything, to go anywhere, or simply go out and enjoy the company of socializing and interacting with other people, even loved ones. Simply put it is very difficult to find pleasure in anything, with no high or low emotions rather like being stuck at a constant medium. Combine that with chronic fatigue and a general baseline of feeling depressed. That is what it is like to come off a synthetic opiate that you took daily for 5 years or better! But I haven't even started on the mental health aspects of my experience. Back to the point of being about 10 days into my detox... I experienced what they call a drug induced psychosis. Which was basically like being schizophrenic but times 10. I was in such a state that when I watched T. V. I was being sent subliminal messages from corporate America trying to indirectly turn me on to something that was extremely important but yet no matter how hard I tried I couldn't understand "what the TV was truly trying to tell me." When I put music on I was convinced that the artists I was listening to had a direct feed into my personal life and were rapping about me, again sending me messages. When I walked down the street the traffic in the road was deliberately trying to lead me somewhere that I needed to follow or sometimes avoid. I mean it is very difficult for me to put in words what I experienced because it's like trying to write something that makes absolutely no sense, but then try to make the reader understand what I was experiencing and trying to explain. Another thing I recall was people around me in stores or wherever they would be on there cell phones talking but they weren't actually talking to anyone on their phones they were indirectly talking to me. Ill stop there with the attempted explanation of what a psychosis was like, I'm sure the reader can see it's basically going from never having any psychological issues to becoming absolutely crazy! It's like the most intense self-centered experience one could ever go thru. As everything, the traffic, people, music, television literally everything surrounding you is directed at you! As if the entire world is circulating around you because everything that happens has to do with someone or something directing a message or a signal to you. Basically I lost my fuckin mind ok. I went from never having any mental health issues perhaps a little situational depression due to my life choices, my addiction, being incarcerated etc. But nothing worthy of note nothing pre-existing here that got triggered in my detox. It wasn't like that, I wasn't previously even slightly off my rocker then thru detox it enhanced it. No it was more like being completely normal experiencing what I was considering my best life to being completely utterly insane! So naturally 3 weeks into this I had lost my job, my car broke down, and I wasn't leaving my apartment at all. It progressed and got worse for a period of, no exaggeration here, almost 3 years. I moved back in with my mother and step father in 2017. Having lost everything I worked for and accumulated, even my pets! My family thought I was gone beyond repair that I would never be myself again. I went to the psychiatric hospital a few times and they couldnt even explain what had happened or the why I ended up in such a long state of insanity. Id say it was about 2020 at which point community mental health workers had been coming to my mom's place 3 times a week to check in on me. I had been taking a medication called Abilify for quite some time at this point. And I don't know hard to elaborate on but I just kinda started to snap out of it. Then eventually I did completely snap out of it and I was wonderfully sane and capable of sitting down and having a rational conversation again. The catch was severe depression lingered, a depression that was more intense than the horrible adjustment phase of not having methodone to jump start brain synapses, and working with a completely deleted amount of dopamine and serotonin levels. It became my personality a general baseline of depressed. Sane again yes but depressed to the extreme of finding little to no pleasure in doing things. Sleeping 12 hours a day, chronic fatigue... Basically discontented at all times. At this point of my life I had been out of prison for 11 years, had 0 police contact, no problems with drug abuse at least not on the level of being anything remotely close to a street junky.
So this turned out to be way longer and more detailed then I had originally intended this to go. I'm writing this for a purpose because I am currently in trouble and I honestly do need financial assistance to acquire legal representation. A situation I never ever thought I would be in again. As I had over 10 + years outside of living in such a miserable existence of constantly worrying about being incarcerated or worrying about my next fix. So anyway I'm sharing my story here to first of all present an honest persective into my life. Yes I struggled for many years but I never once went into the how i got into heroin at age 17. I didn't play the point my finger at the adult game that turned me and my best friend onto the drug telling us it was only ketamine that is essentially non addictive. That I used heroin for the duration of a year before I new it was heroin. Finding out too late because I was already in a state of being chemically dependent. That it was in fact my best friend thru middle and high school, his older brother that turned us onto becoming junkies and mislead the whole way into thinking we were doing a drug that doesn't have serious addictive properties. I mean there are so many blame games I coulda orchestrated in this writing, perhaps sharing my own father being a crack addict that routinely embarrassed me in high school by going on crack binges then coming over to like my girlfriends house and trying to manipulate money outta them. Or having me in the car with him as a kid while he smoked crack telling me to turn my head while he blasted away 50 dollar rocks filling the entire car with crack smoke. My point is yes there was learned behaviors I picked up at an early age that perhaps made me more susceptible to turning out the way I did. Or the trauma I experienced as a child that had me running to drugs to get high at 13 years old. There were so many contributing factors but the simple truth is despite all that stuff, the trauma and learned behaviors all the things the licensed therapists will play on and then tell u it's not your fault. Well I kinda disagree with all that because no one forced me to do the things I did, I made a conscious decision every day in doing the things I did until it completely spiraled outta control and my life became completely unmanageable. Textbook powerlessness over the ability to simply say no and to just stop using. I couldn't do that, I still can't do that I have to be on medication to balance myself out if I'm not using. Because I dont feel normal or happy when I'm not on my medicine in fact I'm out right miserable. Which brings me to the current perdictment I'm in, with the legal issues. To get to the point of summing this up after 12 years of no legal trouble I did end up being charged with a felony. I had given an old friend a ride and he stashed a meth pipe in my truck, that had been there for over 6 months without my knowledge until the day came where I was pulled over. And with my history when I get pulled over they search my vehicle every time! And yes this happened and they find this meth pipe and apparently meth is like the worse drug in the world to be charged with. Over having a meth pipe in my truck I was charged with felony possession of methinphetamines. I go to court and because of my past the charges from over 12 years ago, it enhanced my sentencing guidelines. I was told I was going to do anywhere from 5 months to 41 months, for this pipe found that wasn't even mine. And it mattered not that all this time had went by where I didn't get in trouble and did well for myself. So with looking at prison again, and having mental health problems now being a bit older and settled down... I completely panicked over the ideal of long term incarceration again. So I signed up for the mental health court program which is basically the same thing as drug court for those that are familiar. And I did 18 months on this program of seeing the judge every single week to check in with status reports. Going to take drug tests 3 times a week. Doing mandatory counseling 5 days a week at community mental health on top of seeing my recovery coach once a week and my therapist once a week. To top it off with 5 NA/AA meetings a week. I did all this for 18 months only had 6 months of this intense probation left to go. Then my uncle died of lung cancer and the man was like a father figure to me. I relapsed and I can't really explain the why, it was like I was in a state of just not caring being so lost with grief is a overbearing thing idk but yes I relapsed. I immediately told on myself, told my therapist told the judge told everyone on the mental health team. And the judge was not happy I told her I had a rehab set up and I could get in that very next day. I went on to tell her that there was a 90 day program they offered at this facility and I was aiming to get into that. She then completely cut me off said I was to go there I was to do not a day less than 90 and if I deveaated in any way she would take me off this jail diversion mental health program that I would be resentenced on original charge and basically it wouldn't be good! And I do know from experience in my dealings with the judicial system and being around other inmates hearing there stories, that when put into one of these jail diversion/ sentence diversion programs like mental health court or drug court.. that if you sign up for it then end up messing it up not completing for whatever reason that they go to the very high end of your sentencing guidelines and give you every bit of time they are permitted to according to your scoring sheet.
Coming to conclusion here I went to this program and IMMEDIATELY found out that the 90 day program they offered was merely for a select few individuals that there was never bed space to get into it and unfortunately you had to of been from that same county receiving funding from that particular county in order to get accepted into it! So I was a far ways off from even being remotely close to being eligible for this 90 day program that my judge demanded me to do. Then I find out my program is only a 2 week program which is a far ways off from 90. And I knew my judge wasn't gonna wanna hear any kinda excuses or reasons. So what I did was I did 2 weeks then I applied for 2 week extensions at the end of my 2 week funding period. Long story short here I got 7 weeks in and then my funding source decided that was sufficient and I wasn't getting anymore funding for additional time there in the program. So I panicked and I ended up calling medicaid switching my address to a local address then I called the local funding source for inpatient rehabs and I gave them this new local address. Well they issued me more funding to stay and I thought I was good, no worries. Few days later I'm being told that I have to zoom in for mental health court that day which was not routine at all as I had been there 8 weeks almost at that point and never had to zoom in because the judge new I was in rehab. So I zoom in to court the judge tells me that I'm to leave the rehab and report immediately the following Tuesday to court for resentencing that I was being kicked of the program because I was no longer a resident of Lapeer county. I tried to explain and I was shunned wasnt allowed to explain then I got hung up on whole on the zoom app. I immediately call my therapist because she's part of the mental health court team. She tells me that in changing my address and using it to fasely acquire funding for medical services in a fraudant way was in fact a felony. Then she said that she was sorry but there was nothing she could do for me that the judge was gonna resentence me. So my life flipped upside down immediately here I am in rehab going on almost 8 weeks doing great participating the best I could attempting to get the most I could outta the experience so I could get out stay clean and move forward with my life and be off the court probation thing it under 6 months. To my reality becoming I'm not going to do 41 months in prison over a meth pipe which is technically a paraphernalia ticket but they trumped it up to a felony and now I have to go back after 12 years of being out. I stressed and stressed and stressed then I ran. I didn't go to court because honestly I'm scared to death over the idea of going back to prison. I struggle with mental health problem now, I'm older and simply just not the young healthy person l was when I had to go in last time! I convinced myself that I wouldn't mentally be capable of enduring that again in the current state of my well-being. And I left the trailer I own because staying there woulda been me being arrested with in a week. So now here I am staying with a friend no money no job no where to go family mad at me and im looking at 41 months :( .
I need help I'm trying to raise 5 grand to retain this lawyer that already knows the ins and outs of my whole case. And believe he can get me a deal to no prison time! Which is a miracle because as of now I'm looking at 41 months! So we're talking roughly 30 months being shaved off for an expense of 5 grand! That is worth the money it's worth me doing something like this that I would under normal circumstances not even think about writing my personal life to be painted on the internet for the world to see. And maybe just maybe a few individuals out there that have the means to help people financially will read this and decide I've suffered enough in my life time already and won't wanna see me go do 41 months in prison!

Does this plan have any legs?
Current primary: 588 sq ft 1/1 near the beach in So Cal. Paid 500k for it in 2021. Live with fiancé and 2 cats. Want kids in the future (34M, 29F). Need more room. House needs new foundation (50k). Love the area and don’t want to move.
Investment property: my brother and I own a condo that we rent out. It’s probably worth 140–150k. If sold my take away would be 70-90k including the rents we’ve been stashing.
Family land: own 13 acres up north. Can maybe get between 100-150k for it. Would have to split this 3 ways so 33-50k take away.
My fiancé and I make about 150-170k combined. No other debts. 800+ credit. I have about a 45k emergency fund.
Here’s the plan. Sell the condo (bro wants to sell), sell the land, use money from both sales to replace foundation and add a bedroom and bathroom to the house, then afterwards take out a heloc on the house and tap some of the created value and equity (we have 110k equity right now as is) and launch that into a new investment property as a fat down payment aiming to buy a duplex for under 200k (Midwest).
Making somewhat large Assumptions: 1. we can get what we expect on both sales and it’s enough to cover both the foundation and the addition. 2. We can purchase a duplex that rents $700-800 per side and doesn’t need major work. 3. Fiancé and I can get approved for a heloc followed by a mortgage. 4. The rent would more than cover the heloc payment and the mortgage payment (would hopefully be tiny if existent at all. 5. The heloc would be enough to make the purchase happen.
Does this plan have any legs at all or is it a pipe dream? The hope is to upgrade our home and leverage some of that created equity into another investment property.

2023.05.30 05:31 United-Fly5914 Lawsuit and business failure. Chapter 7?

I was an owner operator truck driver and could not stay profitable. I used credit cards to keep going during COVID and when fuel prices spiked after the Russia invasion. Combined with major repair bills for the truck, I couldn't keep going and shut down last month. Have about $20k in credit cards. I am also getting sued for breaking a lease on a commercial building I used to store the truck and parts about 5 years ago. They want $24k + fees and court costs. The plaintiffs attorney will not even talk about a settlement.
So I'm in about $44k deep.
The truck went to auction and will bring about $12k. I have moving expenses and back taxes that the money will go to. Anything left I intended to use to get a newer car because my Kia is falling apart.
No assets and I'm broke. I don't own any property other than an old car and some furniture.
Texas has a $50k personal property exemption, which I won't even get close to. Selling everything else I own would not even bring $10k.
So considering more than 50% of my debts are business related and I have no ability to pay them back, and my income was only $18k last year, am I a good candidate to file for chapter 7?

We all use influence other people to advance our goals, to motivate others and to help them realize their own goals. Influencing happens all the time and in many different ways. As long as we inspire, motivate, convince, persuade, seduce or use assertiveness most people will agree that we are acting within the frame of healthy social life.Every now and then, however, we will use a different tactic: we will manipulate people to get what we want. There are a lot of negative connotations connected to manipulating. The reason is that, contrary to the first series of tactics, manipulation works with unfair means and does not respect the personal rights of the second party (now called "the victim"): it violates his integrity, works with hidden agendas and deliberately uses dishonest tricks like faulty reasoning, coercion, blackmail and lying in an attempt to control the victim's actions. Manipulation also is unbalanced: it is about suiting the manipulator's advantage or purpose only, often even at the expense of the victim.So, in theory, the difference is clear enough: influencing is positive, manipulating is negative. Influencing is ethical, manipulating is not.In practice, it is often more difficult to know when you are being manipulated and how to best defend yourself against it: Manipulation is unbalanced, the manipulator is trying to benefit at your expense. Yet one of the tricks he will use to reach his goal, is to convince you that you are the one who is to benefit most.How can you know whether a person is hiding information from you in an attempt to mislead you? How can you be certain about the final intentions of another person? It's often really difficult to recognize manipulation when it happens. After all, if we are aware that it is happening ... would we allow ourselves to be manipulated? One of the reasons that we ignore to recognize manipulation is that it goes against the very basics of honest behaviour: We want to be respected, appreciated and loved for whom we are. This implies that we avoid hurting others, avoid lying, feel we deserve the benefit of the doubt and therefore treat others as innocent until proven guilty. Because we act like this, we assume others do too. Every now and then however, we will meet with people that have a different approach to life. As a rule, it is safe to say that when things look like bullshit and smell like it, they usually are bullshit. When you feel uneasy about a relationship; when you have to give in too much; when you feel like having to walk on egg shells; when you feel guilty, humiliated or imperfect after yet another difficult conversation; when choices become power-games; when affection turns green with jealousy or becomes overwhelming, exclusive and possessive; when there are half-truths, lies, denials surfacing; when everything that goes wrong somehow is your fault; when you feel you are pressured to take decisions you do not agree with ... chances that you are being manipulated are very real.If you already know this, than you also know a manipulator rarely comes unprepared. Feeling that you are being manipulated is one thing. When someone close to you or in a situation of power suggests that you do something against your will, how do you feel? Probably not good. How often do you experience or hear of people who seem to have been blackmailed into accepting life-changing decisions (such as choice of education, career, and marriage partner), because their parents, partners, bosses, best friends, or children thought it was best for them.Everybody who wants something from somebody else is a potential manipulator. Especially when the feeling is that they can get what they want more easily in a covert way than in open and rational ways.Manipulation often is about power. Manipulators want the power to dominate you, to force you to give them whatever it is they are after to feel important, safe, comfortable, valued, loved, …: obedience, loyalty, cooperation, support, vote, silence, energy, time, work, money, attention, companionship, friendship, love, sex, … your Chinese Vases … really anything. No wonder that manipulators come in all kinds, as we will see in the next chapters. All salesmen are trained in “sales techniques”, many of which are in fact “manipulation techniques”. Important however is to realize that everybody will try to manipulate others every now and then. Though ethically never a good solution, in the real world we will all sometimes use manipulation to win time, because the favour required is not important, to prevent a mayor bad, to avoid arguments and frictions, “because this is for a real noble cause”, etc… Manipulation becomes a problem only when the manipulator advances his own interests at the expense of this victim’s and causes mental, physical, financial or other harm.According to clinical psychologist Dr George Simon, often, manipulators in many ways are dysfunctional people who conceal aggressive intentions and behaviours; know the psychological vulnerabilities of the victim to determine what tactics are likely to be the most effective, and have a sufficient level of ruthlessness to have no qualms about causing harm to the victim if necessary.Manipulators also need to advance their own purposes and their own gain, even at virtually any cost to others. They need to attain feelings of power, and superiority in relationships with others and need to feel in control.Dr Richard Paul and Dr Linda Elker write: “The human mind has no natural guide to the truth, nor does it naturally love the truth. What the human mind loves, is itself: what serves it, what flatters it, what gives it what it wants, and what strikes down and destroys whatever threatens it”.Manipulators know this very well. While I have been updating my blog post on Etsy payment reserves for the latest developments: https://www.cindylouwho2.com/blog/2021/10/22/etsy-payment-account-reserves-what-every-seller-needs-to-know the recent increase in reserves indicates we need to also update the detailed research.
Etsy's policy page states that the possible factors for having a payment reserve include (with my comments in square brackets):
  1. How long you’ve been in business on Etsy (including how long since you’ve made your first sale)
  2. Details of your sales (including volume and average sales earnings) [averages are recent, not over the life of your shop]
  3. The extent of any backlog of orders from your shop
  4. Availability of shipping tracking information
  5. Types of goods you sell (whether they’re ready to ship or made to order)
  6. Ratio of cases (disputes) opened by buyers in respect of your sales
  7. Suspensions or warnings already received [this includes intellectual property issues]
  8. Estimated delivery times; and
  9. Shipping status of active orders
In the past, we've been able to identify the reasons for most reserves as involving 1, 2, 3, 6, 7 and arguably 9 (which can cross over with 2 and 3).
But the policy page does not cover every possible reason. Some sellers have helped me put together a list of other possible factors, as shown below.

If you have recently been placed on payment reserve on Etsy, do any of the situations below apply to the affected shop?
A. recent hacks or attempted hacks of your shop
B. longer delivery times for most orders
C. use of "Other" as a shipping carrier option when listing
D. no current credit card on file for Etsy Payments (please check this - they do expire)
E. high daily bill for Etsy Ads or Etsy Labels
F. a daily deposit instead of weekly or monthly
G. most orders are made to order instead of ready to ship (including POD)

Anybody have a cool “traveling” tech job? I remember at my last company the supply house had a guy who was essentially your “tech support” but he also had a region he would service where he’d come on location to help diagnose issues that couldn’t be solved over the phone or if equipment was being weird. This was in a residential/light commercial application at least too
If you have that job, do you enjoy it, does it pay well compared to working at a company being a technician (sales tech or non-sales tech, I don’t care what you like to be called or do, just do right by the homeowner and not your paycheck), what’s your region like, how did you get that job?
I’ve been doing HVAC for four years now, I love the driving aspect of the job, I’m very introverted in ways so windshield time helps recover my social battery level and it’s fun to listen to music, podcast or audiobook too in between calls

69D Checkmate: Acquiring BABY With LBO Financing

I should start off by clarifying what I have discovered in that BBBY, the parent company, may not be the target for acquisition anymore.
The reason for that is because the covenant restrictions, liens, and debts have been removed through chapter 11 restructuring (thank you shorties) and no longer prevent BBBY from selling its prized crown jewel and subsidiary asset: buybuyBABY.
Therefore, the most logical step is to just buyout BABY directly in a carve-out and that is exactly what has already taken place which I will prove here.
So how was this LBO deal financed and handled?
I have discovered 2 major rounds of funding sent to BBBY for carve-out of BABY, but first:
  • Recall the Billion Dollar Pooled Funds that are under direction and control of Brett Icahn
  • Recall the Buying Ratio for co-investing of a $39 to 1 ratio where the "employee" Isthmus LLC under control of Brett via Icahn Capital, and that whenever the employee makes an investment up to $7.5M per transaction then the "employer" $IEP will match up to $292.5M for combined $300M maximum per transaction
Round 1 Financing - Creating the DIP Agent Lender and DIP Facility for ch11
The first round of funding delivered to BBBY came from $IEP indirectly through a Shelf-Registration filed with SEC on July 26, 2022 by pledging up to $400M in $IEP Depository Units (put up as collateral for loans). I mention indirectly, because those funds were routed to Sixth Street Partners then given to BBBY.
On August 24, 2022, BBBY received up to $400M in emergency funds needed to stave off bankruptcy, according to Barron's:

While MSM is known for spreading FUD, they were at least able to confirm this in half-truths but I will correct it:
Sixth Street provided this emergency loan of $400M to BBBY, but with good intention because BBBY knew they were being cellar boxed to bankruptcy. Sixth Street has been identified as the DIP Agent Lender in $BBBYQ ch11 court docs and is legal counseled by Proskauer Rose via IEP, as I mentioned in part 1 post.
The first round of funding enabled the Activist Investors to save Bed, Bath, and Beyond, while simultaneously become the stalking horse, and gaining Super Seniority to acquire Assets in the ch11 court sales by providing the DIP Facility (another signature move by Icahn).
None of this would have been possible without the shorting hedge funds and abusive naked shorting that essentially led to the creation of the ultimate bear trap and has now revealed they are swimming naked with 348 million shares oversold to retail investors - Check ✅
Round 2 Financing
This will be broken down based on IEP filings into two parts to see the movement of the Funds.
Part 1, beginning in the first quarter of 2021 and reported on IEP 10Q filing on page 13, here summarized:
As of March 31, 2022 and December 31, 2021 Brett had investments in the Investment Funds with a total fair market value of $86 million and $93 million, respectively. IEP also entered into a guaranty agreement with an affiliate of Brett Icahn, pursuant to which IEP guaranteed the payment of certain amounts required to be distributed by the Investment Funds to such affiliate pursuant to the terms and conditions of the Manager Agreement (terms of the Buying Ratio).
I mention this part to understand how much Funds were available to Brett, which is $86M based on fair market value (these were pledged depository units for loans) as of March 31, 2022.

Now for Part 2, beginning in the first quarter of 2022 and reported on IEP 10Q filing on page 13, here summarized:
As of March 31, 2023 and December 31, 2022 Brett Icahn had investments in the Investment Funds with a total fair market value of $49 million and $50 million, respectively. IEP also entered into a guaranty agreement with an affiliate of Brett Icahn, pursuant to which we guaranteed the payment of certain amounts required to be distributed by the Investment Funds to such affiliate pursuant to the terms and conditions of the Manager Agreement (terms of the Buying Ratio).
By March 31, 2023, it appears Brett invested some of the Funds and after doing some basic math: $86M minus $49M comes out to $37M utilized.
Following the terms of the Buying Ratio for $39:1 to enable co-investing, Brett would have had to make several transactions between 12/31/21 to 3/31/23, but each transaction would have been capped at $7.5M each, however, when aggregated it comes out to $37M for that period.
So $37M x $39 = $1,443,000,000 or $1.443 Billion combined investment from $IEP, as directed by Brett.
Where did that money go?
It was given to B. Riley Securities (representing the mystery buyer IEP) to handle the transaction, since Hudson Bay Capital was removed after the Form S-1 was pulled (see post 1, section titled, "Preferred Stock via Form S-3 That Is Active").
Oh and this will help too, a screenshot from Pitchbook data that tracks Mergers & Acquisitions:

Remember when RC tweeted that he bought all the stocks on January 18, 2022?
Looks about right: buybuyBABY has been carved-out with LBO financing in a cash & share acquisition offer.
The buyer is B. Riley Securities providing $1.443B cash and Lazard providing a [unit] share swap received from RC Ventures via Indemnification Letter then entered into structured deal that binds IEP, RC Ventures, Activist Affiliates, and Interested Parties in the Dealer Manager Agreement.
Here's a break-down to see how the buyer(s) were structured in the deal:
  • Debtoseller: BBBY company to sell buybuyBABY asset in ch11
  • Buyer: B. Riley Securities (BRS) acting on behalf of the mystery buyer(s)
  • BRS combines IEP (cash) and Lazard (shares) for the offer
  • Lazard represents all the buyers under the Dealer Manager Agreement (DMA)
  • The DMA represents a consortium of buyers: Activist Affiliates including Pulte, RC Ventures, Interested Parties, and IEP
BABY is ready to IPO into TEDDY as soon as the stalking horse bidder is announced and the terms of the asset sale are finalized through ch11 formal proceedings.

TLDR, Summary of Entire Post:

  • Carl Icahn created a Succession Plan on October 1, 2020 as a challenge for the young Brett Icahn to ascend the throne, where he will not be paid until he completes a task within 7 years or less
  • Carl has pledged a vast amount of his wealth from $IEP, the Depository Unit shares as collateral to raise a Multi-Billion Pooled Investment Fund that co-invests as the "employer"
  • Brett Icahn has been promoted to direct investments as a General Partner of $IEP and through his role as "employee" of Isthmus LLC

Long story short, I was 7 or 8 in the early 90s and two friends and I were messing around with some fireworks in a field. It was hot and dry in central FL, things quickly got out of hand, and we ended up catching the field on fire. Luckily it wasn't near any houses or property, and no one got hurt, but suffice to say I got in a lot of trouble.
My parents grounded me. I don't remember if it was the first night or second night stuck in my room, but my Dad called me into the living room. He showed me something on the TV. I don't remember if it was a show, movie, commercial, or some sort of safety video, but I do remember it was about fire. I'm not 100% sure, but I feel like it was about a child playing with fire, maybe. I don't remember much of what I watched because the segment or scene wasn't very long and it was the ending that stuck with me (not sure if it was the ending of the piece or just the last part I watched).
It was a woman with big glasses standing next to a child. The background was dark; I remember it as black, but it could have been just a dark room. I remember the child looking younger than me, maybe 5 or so and had severe burns on his face and no hair, obviously due to his burns. They were standing next to each other sort of like they were being photographed for a portrait.
After seeing it I remember my Dad telling me that's what happens when you play with fire, or something to that effect.
I have had frequent nightmares about this scene. As a child I would dream about being hot and in pain, like I was burned, or being stuck in a dark smoky house. Either way I would find my Mom in the bathroom and stand next to her. There would be a large mirror in front of us and when I looked into it, I would see the scene I had seen on the TV except it was me and my mom instead of the woman and child. My hair was gone and I was burned just like the child was. I actually still have this nightmare from time to time as an adult.
I know this isn't a lot of information to go off of, but would appreciate any thoughts or information.

I was going to let this one go but the version up on Dime is missing a song.
It was another date night, and I also had edibles, homemade and much stronger than expected. The wind was bugging again and I could barely keep the mics mounted, more due to the substances coursing through my system than any technical problems. And you only have some other taper to blame for giving me infused treats to capture his avant garde favorites, where a heavy dose of THC is a must for endurance.
This tour was a little controversial in my digital neighborhood from all ends to the people who think just because they are fan they are entitled to be one of the 15,000 inside out of the 25,000 who wish they were at either the lowest price possible or the highest, outbidding everyone else in the process. And the brokers who think feel entitled to grab all the tickets and charge whatever they want for them to Michael Rapino who was a bit inconvenienced but would rather suck it up and play along and maybe give some money back than let AEG book the tour.
Reeves Gabrels might be my favorite guitar player ever, not just his work with David Bowie (and I still maintain "Outside" is my favorite album of his) but his solo album "Ulysses" is particularly spectacular. Though his work with The Cure is a bit more restrained to that particular style, I was very happy for him when he landed this gig. And I wish I had something resembling an adult income when he was doing his regular residency at the Baked Potato where I would see the show, eat a massive spinach potato topped with jalapenos smothered with Tabasco sauce and then walk the 5 miles home to get up in 4 hours and go to work. Was only able to manage that a few times but if it were ten years later I would go to every single one and Lyft it out of there.
Speaking of good gig eats, it wouldn't be a Hollywood Bowl show if it didn't have a fair amount of wrapper crinkling thanks to the Bowl's infamous BYO policy and my love of hot peanuts and addiction to infused edibles. I tried to secure to my mics to a mask under a hoodie because these mics don't like even the slightest breeze but didn't quite work the way it used to especially with me stuffing my fat face all night.
There were T shirt kiosks crammed into corners I had never seen them before and every line like Space Mountain 4th Of July. The price? $25! Only 3 or 4 with simple designs as not to overwhelm the senses, and credit card. I don't think they cost that much since the 1990's. I never buy arena shirts but I still had to get one for my dearly neglected. Already seeing these shirts everywhere now. I doubt KISS sells as many in November as The Cure did on a Wednesday night. Wouldn't be surprised if they can even best regular merch sales record holders Iron Maiden in equivalent venues. I bet The Cure would even be undercutting the bootleg guys outside selling for $20 if the Bowl and LiveNation's hefty fees allowed.
Being date night with a traditional buy your tickets a year in advance and pay for parking patron, and I did what I almost never do anymore and buy advance in the fan to fan exchange so she would have something to look forward to, and crossed my fingers they wouldn't be canceled. I paid $192.40 for the pair, beating my record high of $40 to get into Pasadena Daydream. I got the dreaded U31 error on the first try but switched to another browser and pulled them again, but unfortunately was logged into my (former) business buy account so I was a little nervous because for a while I was spending an amount that seems so unreal to me still, even now. All that was left active were stacks of Matchbox Twenty that were sold or refunded in early 2020 for a tour that just kicked off a few weeks ago.
If anyone knows Michael Rapino, tell him to get his IT guys on that error. Not everyone says fuck it and buys in the lot day of show like I do. He may be rich but it's Never Enough and he can always use more so there is no reason regular fans with money to spend should be denied tickets they took the time to try to purchase. People are missing shows and his $122 million payday could be a little higher if he can take these customer complaints seriously and fix this constant issue.
There is so much I can say about Robert Smith's ticketing policy, especially since I am of the opinion "my ticket, my money, my property" but that opinion has evolved a bit with this tour and I can't really say I am unsatisfied with how it worked out. On it's face it looked fair to everyone and those looking to profit were sufficiently warned. Now those regular fans who had their tickets canceled might think different. It's all algorithmic, it's not like they were using a secret list of known offenders. For example, if you go to a lot of shows and have eclectic tastes you are eventually going to get your tickets canceled for something in addition to never getting the verified fan codes.
Now Eddie Vedder did the same no transfer and fan to fan resale for his YouTube Theater show. When it half sold, he lowered the prices while previously purchased tickets listed for resale were locked into the price floor at the original price, twice what even closer seats were eventually listed for. Or Ed Sheeran, notorious for inconveniencing fans in addition to resellers with his spurious ticket verification checks for secondary purchased tickets outside venues where they would cancel the tickets on the spot and resell them. Now I am getting regular notifications of discount Ed Sheeran tickets from stadiums across the continent. In a kinder, gentler era where the free market reigned it would be the third parties assuming some of the promoter's risk and taking those losses. But this tour sold out 100% instantly and any unwanted tickets had the auto refund built in because tickets resell the second they are listed on the Fan To Fan exchange, unlike Eddie Vedder where that money spent was lit on fire.
I know I get always get a clueless knee-jerks from drooling mouthbreathers when admitting to the cardinal sin of selling a sacred ducat for more than face value, especially on The Cure Reddit where I got multiple accounts banned for harassment for merely explaining how the business works from my perspective. Maybe one of those folks can answer this simple question, if I don't even qualify for housing anymore, why should I care what someone spends on a concert ticket? Or better yet, will anyone in Glendale or Burbank, California who bought their house 2010 or earlier sell it to me for what they paid? The worst is thinking of life without teeth because after three decades of neglect, once I hit the tipping point I was able to go to the dentist I liked and say do what you gotta do then just paid the bill. Still my biggest splurge, spending more than my Ireland and Finland trips combined. So what if you spent $40 more than me for a pair to Dancing With The Stars.
Right now if it's not The Cure, Taylor Swift or K-Pop, pretty much everything is $10 or so day of show. Prices fall so hard, so fast I am legitimately worried brokers will start going bankrupt and stop bulk harvesting inventory leading to the collapse of the secondary market and Ticketmaster might actually become an almost monopoly.
For those of you still looking for tickets, keep in mind there is no guest list and Robert Smith is personally handling sales to friends and family but god forbid any of Bob's friends have to pay a very fair price to see this show, and anything still unsold goes back to Ticketmaster and even the box office day of show where my friends were getting Garden Boxes out the window for all three shows.
Enough about tickets, now that the cat is out of the bag how I funded my all concerts all the time lifestyle for so long, I hope to tell that story someday. The secondary market is not what you think it is. And with the exception of Ebaying my Inland Invasion 2003 ticket for rent money because I couldn't get a ride, I have never sold a single ticket for The Cure. For more on that subject I highly recommend the Bob Lefsetz podcast interviews with both Ticketmaster founder Fred Rosen and current LiveNation chairman, the aforementioned Michael Rapino who talks a bit about this tour.
Nice to see a few classic Reeves style solos on "A Night Like This" (replacing the sax solo on the original) and "From The Edge Of The Deep Green Sea" especially with the absense of "Wrong Number" and "Yesterday's Gone" in the set. I know they are keeping a dividing wall between his projects but I sometimes wonder how David Bowie's "The Motel" would sound interpreted by this band.
The music itself was nothing short of divinely inspired and perfectly delivered but the backlighting and inefficient use of screens means you can pretty much get a seat anywhere in any building and it won't really matter. Sit in the back row, eat an infused chocolate and enjoy the sights and sounds even if you don't see much of the actual people onstage. I liked the 2016 visuals better with Reevesvision on the left jumbotron all night. Got to hear at least some of my favorites though I have soft spot for my first ever purchase "Wild Mood Swings" but they do play "Want" some nights, if not this one. Got "Disintegration," "A Night Like This," "From The Edge Of The Deep Green Sea" as well as many yet to be released songs that are meant more than sending people to the loo or for more underpriced merchandise. Robert Smith believes in them enough to put them in the set every night and should be given the same attention as the classics you, if not me, grew up with. He still takes his craft seriously in addition to the business.
There are likely better recordings, even of the same night, and as is often the case this serves as more of a vehicle to tell my story than just kicking another show out there for the obsessive compulsives to put on a soon to crash hard drive without ever hearing.
I was planning on going the last night and splurge on a garden box if possible but I did have a free show by Kara Jackson on my calendar and though I had yet to hear a note, I sampled a song and decided to save myself the cash. It was worth it to spend, but the Bowl is just a bit too much to deal with three nights in one week. Foot, car, shuttle, there is just no easy way to get out of there.

With the upcoming 10-year anniversary of El Reno May 31, 2013 here are some links to videos and articles about or related to this event, with a focus more on the science, as well as footage links so they can all be in one place for anyone looking. This is by no means remotely exhaustive, and will not include the numerous documentaries or news articles about this event. Rest in peace to the eight people killed by the tornado and the many others who died due to storm related flooding. Five of the eight killed by the tornado were storm chasers. Three were veteran chasers Paul Samaras, Tim Samaras and Carl Young and the others were amateur chaser Richard Henderson and another unnamed chaser who was only discovered later to have been chasing that day through the work of the El Reno Survey project. A couple writings/discussions about the final rating Chuck Doswell's EF Scale Rating's Brouhaha and More on the EF-Scale Controversy Old Stormtrack thread that Jeff Snyder participated in. Both this thread and Doswell's writings above were from 2013 so other things have since been gleaned from this event, but both contain most if not all of the more informed reasons for the argument around the rating. Snyder wrote the paper linked above about considerations for using mobile radar in determining tornado intensity the following year. Adding the Current Proposed Revision to the EF Scale since a lot of those more organized discussions seemed to have stemmed from this event.
(note: I enjoy the science involved in aspects of the rating, but personally find the ratings themselves boring and uninformative as they merely simplify something very complex into a metric (that then is reduced even further into wind speeds) that a lot of times just seem to operate as a function of competition and/or morbid destruction allure. In general reducing everything involved in a tornado to a static thing with defined borders and simplified properties isn't helpful in understanding all the forces themselves or in understanding the complex way those forces interact with everything around them. I recommend reading the damage survey and discussion links above to help understand the reasoning given for this particular rating and the science of the considerations around radar indicated speeds and tornadic intensity along with some more well thought out arguments against the rating this event was given. If for no other reason than to move away from more common subjective-bias based arguments ("i know a huge EF5 when i see one" "obviously from the footage it was a massive wedge EF5 world destroyer") and in to more informed discussions if they must happen.)

Neither of course contain all the footage but are especially good to watch just so you can see how radically different it looked at different times depending on where the person was. The second one has a minor sync error that is noted in the pinned comment. None of the Sellers or the Acquired Entities is a party to any shareholders’ agreement, voting trust agreement, registration rights agreement or other similar agreement or understanding relating to any such securities or any other agreement relating to the disposition, voting or dividends with respect to any such securities. Except as set forth on Schedule 3.4(a), the Sellers own all of the outstanding capital stock or other equity interests of the Acquired Entities, free and clear of all Encumbrances (other than Permitted Encumbrances).
🚀Purchase and Sale of the Acquired Assets.
Pursuant to sections 105, 363 and 365 of the Bankruptcy Code, on the terms and subject to the conditions set forth herein and in the Sale Order, at the Closing, Sellers shall sell, transfer, assign, convey, and deliver to Purchaser, and Purchaser shall purchase, acquire, and accept from Sellers, all of Sellers’ right, title and interest in and to, as of the Closing, the Acquired Assets, free and clear of all Encumbrances other than Permitted Encumbrances. “Acquired Assets” means all of the properties, rights, interests and other assets of each Seller as of the Closing, whether tangible or intangible, real, personal, or mixed, wherever located and whether or not required to be reflected on a balance sheet prepared in accordance with GAAP, including any such properties, rights, interests, and other assets acquired by any Seller after the date hereof and prior to the Closing, and including Sellers’ right, title and interest in and to, as of the Closing, the following assets of each Seller, but excluding in all cases the Excluded Assets:
